MOYER, of 4 Willow Mill Park Road, Mechanicsburg, Cumberland County, Pennsylvania, being of sound and disposing mind, memory and understanding, do make, publish and declare this as and for my Last Will and Testament, hereby revoking and making void any and all former Wills, Codicils, or writings in the nature thereof, by me at any time heretofore made. FIRST: I hereby order and direct my Executor, hereinafter named, to pay all my just debts, funeral expenses, testamentary expenses and all Inheritance, Estate, Transfer and Succession Taxes, as soon as may be conveniently done after my death, out of my residuary estate. SECOND: I make the following specific bequests of personal property: A. I give to my son, THOMAS D. MOYER, of 4 Willow Mill Park Road, Mechanicsburg, Pennsylvania, my Super-A Farmall Tractor, with all attachments, specifically to include but not limited to the mower, plow, cultivator, blade and aerator. also give to him my WD-45 Allis Chalmers Tractor. B. I give to my son, TIMOTHY R. MOYER, of Rich Valley Road, t, ......,:- ......... ......... "'" \ v"l ~ Mechanicsburg, Pennsylvania, my C-Farmall Tractor. \ "- 1 I'~ C. I give to my son, ROBERT J. MOYER, of Whiskey Springs Road, Dillsburg, Pennsylvania, my Super-C Farmall Tractor. THIRD: I direct that my son, THOMAS D. MOYER, who resides with me at 4 Willow Mill Park Road, Mechanicsburg, Pennsylvania, shall have the right to occupy my home, rent free, until his death, or until such time as he no longer wishes to reside there, or is no longer able to reside there, with the provision that he shall be responsible for payment of all taxes and all reasonable and necessary maintenance upon said property as a condition of his continued residence there. My son shall also have the option at any time during his occupancy of the house to purchase that share of said property which I would otherwise have left to his brothers, ROBERT J. MOYER and TIMOTHY R. MOYER, by paying to each of them one-third of the value of my home as of the date of my death, as established by the estate appraisal, or other sufficient evidence. By this clause, I specifically wish to give my son, THOMAS D. MOYER, the right at a later date to purchase the shares of my other two sons at the value as of my date of death, even if in the interim said real estate shall have appreciated in value. In the event that he does exercise that option, my surviving sons, or their issue if applicable, shall promptly execute quit claim Deeds in favor of my son, THOMAS D. MOYER, as a condition for receipt of the proceeds, provided further the parties shall divide any applicable transfer tax equally and otherwise each party shall bear his or her own cost of closing. 2 At such time as my son, THOMAS D. MOYER, dies, is no longer able to reside in the residence, or chooses to reside elsewhere, and provided that he has not exercised the option to purchase the shares of his two brothers (or their issue should either of them fail to survive to that date) said property shall be sold and the net proceeds divided into three equal shares, each to be paid to one of my three sons named above, or if any of them fail to survive as of that date, alternatively to their issue. I further provide that as long as my son resides in my home, he may keep and use all of the household furniture, furnishings, and decorations in the house and garage, but if he exercises the option to purchase the shares of the residence as set forth above from his brothers, he shall at that time divide the furniture into three equal shares, one for each of the three brothers. FOURTH: My late wife, RUTH I MOYER, had a number of collections of various items, which included collections of ceramics, train sets and crafts. These collections may have widely varying values. I direct that all such collections are to be considered separate from the household furniture, furnishings and decorations, which may remain with the house during the occupancy of my son, THOMAS R. MOYER, and that they be separately valued, and divided among those of my children who may be interested in having them, provided that the value of any such collection which is given to any of my children shall reduce said child's share of my residuary estate on a dollar for dollar basis. 3 , . FIFTH: I have loaned various sums of money to each of my three children from time to time, some or all of which may have been repaid as of the date of my death, and some of which may be outstanding. I forgive all indebtedness of every kind that may be owed to me as of the date of my death, by any of my three sons. SIXTH: If any beneficiary under this Will shall, directly or indirectly, by legal proceedings or otherwise, challenge or contest this Will or any of its provisions, or shall attempt in any way to oppose or set aside the probate of this Will or impair or invalidate any of the provisions I have made in it, any gift to, or other provision for that person under this Will is revoked and shall be disposed of in the same manner as if that contesting beneficiary had predeceased me without issue. SEVENTH: All the rest, residue and remainder of my estate I give to my three children, THOMAS D. MOYER, TIMOTHY R. MOYER and ROBERT J. MOYER, in equal shares. Should any of my aforesaid children predecease me, I give such share as would have been paid to said child to the issue of said child, or if there be no issue, to be divided between my surviving children, or their issue, if applicable, in equal shares. EIGHTH: Should any minor child be entitled to be a direct beneficiary of my estate, I direct that my Executor shall designate a local bank (or other appropriate fiduciary), after consultation with said bank or fiduciary, to serve as Guardian of the estate of any such minor beneficiary. 4 LASTL Y: I nominate, constitute and appoint my son, THOMAS D. MOYER, to be the Executor of this my Last Will and Testament. In the event that THOMAS D. MOYER shall be unable to serve as Executor for any reason, I appoint my nephew, FLOYD FAHNESTOCK, of 1849 West Lisburn Road, Carlisle, Pennsylvania, as Executor.
