NAPOLI, CIVIL ACTION-LAW Defendant JURY TRIAL DEMANDED COMPLAINT AND NOW comes AAA Mid-Atlantic Insurance Group a/s/o Alfred Shipe, by its attorneys, Goldberg Katzman, P.c., who state: I. Plaintiff, AAA Mid-Atlantic Insurance Group, is a business entity authorized to issue policies of insurance in the Commonwealth of Pennsylvania, with an address of 2040 Market Street, Philadelphia, Pennsylvania 19103. 2. Defendant, Giuseppe M. Napoli, is an adult individual residing at 1320 Swope Drive, Boiling Springs, Pennsylvania 17007. 3. Plaintiffs insured, Alfred Shipe (Mr. Shipe), is an adult individual residing at 813 Briarwood Lane, Camp Hill, Pennsylvania 17011. 4. On March I, 2005, at approximately I: I 0 p.m., Mr. Shipe was traveling westbound on Trindle Road in Mechanicsburg, Pennsylvania. 5. At or about this time, Defendant was also traveling westbound on Trindle Road in Mechanicsburg, Pennsylvania. 6. At or about this time Mr. Shipe turned on his left turn signal and brought his vehicle to a stop at the 5200 block of Trindle Road, in order to turn into a driveway. .' 7. At or about this time, Defendant was traveling behind Mr. Shipe. 8. At or about this time, the Defendant failed to stop his vehicle and caused his vehicle to strike the rear ofMr. Shipe's vehicle. 9. Defendant was negligent in that he: a. failed to keep a proper lookout; b. failed to maintain control of his vehicle; c. failed to safely operate his vehicle; and d. failed to stop his vehicle before impacting the rear of Mr. Shipe's vehicle. 10. As a direct result of Defendant's negligence, Mr. Shipe's vehicle sustained severe damages. II. Plaintiff AAA Mid-Atlantic Insurance Group made payments in the amount of $ 3,905.99 for the damages to Mr. Shipe's vehicle and pursues this subrogation action to recover for the losses paid. WHEREFORE, Plaintiff AAA Mid-Atlantic Insurance Group respectfully requests that this Honorable Court enter judgment in its favor in the amount of$ 3,905.99, together with interest and the costs of suit, against Defendant, Giuseppe M.
