FREEDMAN, DECEASED NO. 2005-00585 FAMILY SETTLEMENT AGREEMENT REGARDING THE DECEDENT'S REAL ESTATE OF THE ESTATE OF SHIRLEY L. FREEDMAN. DECEASED KNOW ALL MEN BY THESE PRESENTS, that: WHEREAS, Shirley L. Freedman, late of Lower Allen Township, Cumberland County, Pennsylvania, died testate on May 13, 2005; WHEREAS, Letters Testamentary on the Estate of the Decedent were issued by Glenda Farner Strasbaugh, the Register of Wills of Cumberland County to the Executrix, Charlotte A. Vacondios on June 28, 2005; WHEREAS, at the time of her death, the Decedent was the sole owner of real estate ("real estate") located at 212 South Locust Street, Camp Hill, Cumberland County, Pennsylvania 17011; WHEREAS, in the Decedent's Last Will and Testament dated December 19,1997, the Decedent bequeathed a life estate, in her real estate, to her friend, Charlotte A. Vacondios, conditioned upon Charlotte A. Vacondios making all mortgage payments and paying for all real estate taxes, maintenance and insurance on the real estate; WHEREAS, in the Decedent's Last Will and Testament, if Charlotte A. Vacondios would move from the real estate or die, the real estate was to be sold and the proceeds divided in equal shares among the following surviving beneficiaries: 1) Clarence L. Nicholson -brother-in-law; 2) Charlotte A. Vacondios - friend; ~-_. - . 3) Steven A. Nicholson - nephew; 4. Valerie M. Nicholson - niece; 5. Diane M. Baker - niece; I...}:,) RK WHEREAS, all of the aforementioned beneficiaries have agreed that Charlotte A. Vacondios should receive title to the real estate in exchange for paying $10,000.00 to each of the other four beneficiaries; WHEREAS, in order for Charlotte A. Vacondios to obtain the funds necessary to pay the $10,000.00 to each of the four beneficiaries, she will have to obtain a Mortgage on the real estate; WHEREAS, the representative for the potential lender, Cody Financial, indicated that title should be deeded from the Estate's name into Charlotte A. Vacondios' name, so that the loan can be deemed a refinance loan; THEREFORE, owing to the requirements of Cody Financial, the other four beneficiaries agree that title can be transferred from the name of the Estate of Shirley L. Freedman to Charlotte A. Vacondios and in order to facilitate the refinancing loan and for Charlotte A. Vacondios to obtain the monies necessary to buyout the beneficiaries. Such agreement is conditioned that in the event Charlotte A. Vacondios is not granted a loan through Cody Financial, title to the real estate will be transferred back into the name of the Estate and any costs related to preparation or recording of the second Deed will be paid solely by Charlotte A. Vacondios. The parties acknowledge that this Family Settlement Agreement will be signed and notarized separately by each of the five beneficiaries. The original signatures will be attached to the original Family Settlement Agreement.
