COMPLAINT
AND NOW, comes the Plaintiff, by and through its attorneys,
Cleckner and Fearen, and in support of the within Complaint, avers
as follows:
1. Plaintiff, Black Landscape Contracting, Inc., is a
corporation organized and existing under the laws of the
Commonwealth of Pennsylvania, and having administrative offices at
1360 East Lisburn Road,
Mechanicsburg,
Cumberland County,
Pennsylvania 17055.
2. Defendants are Daniel D. Strait and Aprile Sue Strait,
adult married individuals who reside at 2463 Hoffman Road,
Greencastle, Pennsylvania 17225.
3. Plaintiff entered into an agreement with Defendants,
memorialized by written proposal to Defendant Daniel Strait dated
April 14, 2005, for certain landscaping work to be performed at
Defendants'
residence at
2463
Hoffman Road,
Greencastle,
Pennsylvania.
The contract sum was $27,850.00.
A copy of the
written proposal is attached hereto, made a part hereof, and
labeled Exhibit "A".
4. The agreement was orally modified by the parties,
resulting in an increase in the contract sum.
5. Defendants made periodic payments on the contract sum
through June 14, 2005.
6. By invoice dated June 30, 2005, Plaintiff demanded payment
of the balance due of $14,267.98. A copy of said invoice is
attached hereto, made a part hereof, and labeled Exhibit "B".
7 . Defendants paid an additional $7,000.00 against the
contract sum, leaving a balance due and unpaid of $7,267.98.
8. Plaintiff performed all of the work in a good and
workmanlike manner.
9. The amounts invoiced are in accordance with the written
proposal, as orally modified, and constitute fair and reasonable
charges for the work performed.
COUNT I - BREACH OF CONTRACT
10. Paragraphs 1 through 9 are incorporated herein by
reference.
11. By failing to pay the balance due, despite demand,
Defendants have breached the agreement with Plaintiff.
12. Plaintiff is entitled to recover the balance due of
$7,267.98, and interest at the rate of 6% per annum.
WHEREFORE, Plaintiff demands judgment against Defendants in
the amount of $7,267.98, with interest at the rate of 6% per annum.
COUNT II - QUANTUM MERUIT
13. Paragraphs 1 through 12 are incorporated herein by
reference.
14. Defendants are owners of the subject property as tenants-
by-the-entireties, and both benefitted from Plaintiff's work.

15. The work was done and the materials were provided with
the involvement, knowledge, acquiescence and consent of both
Defendants.
16. The value of the work and materials is equivalent to the
contract sum.
17. Despite demand, Defendants have failed and refused to pay
the balance due of $7,267.98.
WHEREFORE, Plaintiff demands judgment against Defendants in
the amount of $7,267.98, with interest at the rate of 6% per annum.
COUNT III - UNJUST ENRICHMENT
18. Paragraphs 1 through 17 are incorporated herein by
reference.
19. Defendants have been unjustly enriched to the extent of
the balance due of $7,267.98.
WHEREFORE, The Plaintiff demands judgment against Defendants
in the amount of $7,267.98, with interest at the rate of 6% per
annum.
