COMPLAINT IN CIVIL ACTION AND NOW COMES, Plaintiff by and through its counsel, WELlMAN, WEINBERG & RBIS, CO., LP.A., and hereby files this Complaint against Defendants jointly and severally. In support thereof, Plaintiff avers as follows: 1. Plaintiff, Markel Insurance Company ("Markel"), is a corporation with a registered office located at 4600 Cox Road, Glen Allen, Virginia 23060. 2. Defendant, Rebecca Fomey, is an adult individual with a last known address of 48 West Main Street, Apartment 8, Mechanicsburg, Pennsylvania 17055. 3. Markel issued a policy of insurance where Rockingham agreed to insure a 1997 Plymouth Grand Voyager ("Insured Vehicle"), owned by Plaintiffs insured. 4. On or about May 13, 2004 a motor vehicle owned and operated by Defendant, Rebecca Forney, did negligently, carelessly andlorrecklessly collide with the Rockingham Insured's vehicle at or near the 3100 block of Market Street, Camp Hill, Cumberland County, Pennsylvania. 5. As a direct and proximate result of Defendant's negligence, the Markel's Insured vehicle sustained property damage in the amount of$I,658.85. 6. Pursuant to the terms and conditions of the insurance policy, Markel paid the sum of $1,658.85. A true and correct copy of the payment and damage documentation is attached hereto and marked as Exhibit" I ". 7. Pursuant to the insurance policy issued by Markel and as a result of said aforesaid payment, Markel became subrogated to the claim of its Insured against Defendant. 8. Pursuant to Markel's right of subrogation, Markel is presently due and owed from Defendant the sum of$I,658.85. 9. Repeated demands have been made upon Defendant for payment of the aforesaid sum; however, Defendant has willfully failed and refused to pay the sum due and owing to Markel. WHEREFORE, Plaintiff demands Judgment against Defendant in the amount of $1,658.85 plus interest and costs.
