COMPLAINT
1. The Plaintiff is an adult individual residing at 2217 Kensington Street,
Harrisburg, Pennsylvania 17104.
2. The Defendant is an adult individual residing at 1453 Cockley's Meadow,
Boiling Springs, Cumberland County, Pennsylvania 17001.
3. The facts and occurrences hereinafter related took place on or about
October 22, 2004, on Kensington Street in the City of Harrisburg, Dauphin County,
Pennsylvania.
4. At the time and place aforesaid, Plaintiff was the owner of a 2000 Honda
Odyssey van which was then and there lawfully parked on the south side of the 2200
block of Kensington Street.
5. At the time and place aforesaid, Defendant was the operator of a vehicle
which was traveling on Kensington Street and lost control of his vehicle, striking the
Plaintiff's legally parked vehicle and resulting in the damages hereinafter set forth.
6. The aforesaid accident and damages resulting therefrom were due to the
negligence of the Defendant in that he:
a) failed to keep a proper lookout for other vehicles;
b) failed to maintain control over his vehicles;
C) operated his vehicle at a speed too fast for conditions then and there
existing; and
d) operated his vehicle in a careless manor so that his vehicle left the travel
portion of the roadway and struck the Plaintiffs lawfully parked vehicle.
7. Solely as a result of the Defendant's negligence, Plaintiff sustained
damages totaling Ten Thousand Five Hundred Sixty-Two and 61/100 ($10,562.61)
Dollars for the repair of his vehicle and the rental of another vehicle while repairs were
being made.
WHEREFORE, Plaintiff demands judgment against the Defendant in an amount
not in excess of mandatory arbitration limits.
