My security deposit and rent was $575.00. This deposit was transferred over to the 414 3 d Street, West Fairview address when I moved to the residence. Landlord has garage hooked up to my electric usage for the apartment at 414 3`d Street, West Fairview, PA 17025, in which another tenant was using and I was paying the electric bill. Contacted the office of Sopensky Properties to resolve this issue. Received no response at this time. Called PP & L to make appointment for review of electric usage at 414 3`d Street Apt 1, West Fairview, PA 17025. Mr. Sopensky's office was contacted to also be available for the review from PP& L. Sopensky Properties did not make anyone available for the appointment. Sent Sopensky Properties usage sheet from PP & L 2 times to 3 times during the year to resolve this issue. At the time PP & L came to 414 3rd Street Apt 1, PP & L stated that the garage was connected to my electric. I notified Sopensky Properties of the review from PP & L. On December 20, (approximately 6months later) the electric was finally disconnected by one of Sopensky Properties maintenance workers, who left a note that the garage was disconnected and if I had any questions to contact Mr. Sopensky. I requested a month's rent in lieu of the electric bill. WHEREFORE, requesting: Award of 445.00 for costs for electric bill And Such other and further relief as the court deems just and proper. Sopensky Properties 2006-349/CIVIL August 8`h, 2006 Prothontary Officer: This is an objection to the preliminary objection filed by the defendant Sopensky Properties, 5041 A Lancaster Street, Harrisburg, PA 17111. This objection was filed on March 23, 2006 by Sopensky Properties (2006-349-Civil/1-18-2006). 1. The defendant listed that the Plaintiff received and accepted payment toward these two counts of $375.00. This 375.00 was discussed in the original civil case before District Justice Manlove (2005-349/Civil). This $375.00 did not affect District Justice Manlove's decision on the original case and was not considered as any type of payment on the judgment decision by District Justice Manlove. Judgment decision was made on December 20, 2005, the day of the hearing. The defendant is still liable for payment of $971.50 to the plaintiff. This was a false statement by the defendant on Sopensky Properties objection. 2. Plaintiff acknowledged damage to carpet and defendant stated he would call plaintiff to clean the carpet as requested when the defendant was done painting the apartment, after the plaintiff had moved out. The defendant never contacted the plaintiff as he stated he would do so, to allow the plaintiff to clean the carpet. This damage to the carpet was not from the plaintiffs animal. It was worn and needed cleaned in one area in the living room around a coffee table. This was a false statement by the defendant on Sopensky Properties objection. 3. Plaintiff provided documentation for the amount of the excessive electric bill several times to the defendant. Defendant's stated his staff had lost information (This PPL information was sent to Sopensky's office (at 5041 A Lancaster Street, Harrisburg, PA 17011), on 3 different occasions. The plaintiff mailed all electric usage information two (2) more times to his address. Mr. Sopensky was also notified before PPL was to review the electric usage at the apartment and did not choose to appear when PPL came to the apartment (414 3'd Street Apt 1, West Fairview, PA 17025) on a specified date. This information included copies of electric bills, PPL usage sheet for the apartment and statement that the garage was hooked up to the plaintiff's electric usage and plaintiff did not have access to the garage. Mr. Sopensky rented the garage to another person (not residing in the apartment building). These documents were presented (2005-349/civil) to the District Justice Manlove during the original hearing of the case. Plaintiff was paying for electric that the defendant's other occupant of a garage was using. Defendant had the electric disconnected (several months later) from the garage, after plaintiff complained and had PPL check the electric usage (PPL stated that r the garage was connected to the plaintiff's electric usage. Garage was being used as a workshop with high power tools connected and used daily). A note from the defendents maintenance person was also presented at the original hearing stating that the garage has been disconnected, after approximately 6 months. This was a false statement by the defendant on Sopensky Properties objection. 4. This case should not be dismissed due to the above factors. This is an additional objection by Mr. Sopensky to avoid paying the original judgment by District Justice Manlove (2006-0349-civil). This judgment was ordered on December 20th, 2005.
