STIPULATION AGAINST LIENS
WHEREAS, Commerce Bank/Harrisburg, NA., of 3801 Paxton Stre t, Harrisburg,
Pennsylvania 17111 ("Owner"), is about to execute contemporaneously herewith, a contract with
Premier Construction Group, Inc. of 39 S. York Road, Dillsburg, P A 17019 (" ontractor") for
the construction of certain improvements to said real estate situate upon a lot 0 land situate in
the Borough of Lemoyne, County of Cumberland, Commonwealth of Pennsyl ania and more
fully described in attached Exhibit "A." :

NOW, THEREFORE, before any authority had been given by Owner t Contractor to
commence work on said facilities or purchase materials for same, in consideratio of making of
the above-described Contract with Owner, and in further consideration of One ($1.00) Dollar
paid to Contractor by Owner, the receipt whereof is hereby acknowledged, it is agreed that no
liens or claims shall be filed or maintained against the Owner's property and the land
above-described by the Contractor or any of its subcontractors, or by any of the /naterialmen or
workmen, or any other person acting through or under them, for or on account f any labor or
materials purchased, or extra labor or materials purchased for, towards, in or ab t the erection,
construction, design and improvement of said facilities, under said contract or otherwise, the
right to have, file and maintain such liens or claims against the filCilities and the land
above-described, being hereby expressly waived by the Contractor for itself, its ubcontractors,
all materialmen, or workmen and other acting through or under them. '

ALL THAT CERTAIN piece or parcel ofland situate in the Borough of Lemoyne, County of
Cumberland, Commonwealth of Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point on the northern line of Market Street [sixty (60) feet wide~ at the
southeastern corner of Lot No. 31 on the Plan of Lots hereinafter mentioned; thence by the
eastern line of said Lot No. 31 and through an iron pin two and one-half (2 1/2) fe~t north of
Market Street, North nineteen (19) degrees forty (40) minutes West, two hundred fret (200.00) to
a point; thence by the southern line of Lot No. 29, North seventy (70) degrees tweqty (20)
minutes East, twenty and thirty.three hundredths (20.33) feet to a point; thence by he eastern
line of said Lot No. 29, North twenty-four (24) degrees eight (08) minutes thirty (3 ) seconds
West, one hundred eighty-five and sixty-five hundredths (185.65) feet to a point 0 the south
side of Walnut Street as laid on said plan but not yet opened; thence by the southe line of

et al. in the Court of Common Pleas of Cumberland County, Pennsylvania at No.4 ctober

Lot Nos. 28 and 33 BEING two of the lots which were awarded to Caroline R. H. ~aub in the
said petition proceedings by a Decree of the Court dated September 15, 1936. i

Company, guardian of the Estate of Maude H. Longnecker, a weak minded person, y its Deed
dated September 7,1955 and recorded in the Office of the Recorder of Deeds ofC berland
County, Pennsylvania in Deed Book 16, Volume R, Page 557, conveyed to said C ,oline R. H.
Daub.
Lot No. 26 BEING the same lot which Carol Bigler Brandt and Margaret A. Brandt; his wife by
their Deed dated May 10, 1950 and recorded in the Office of the Recorder ofDeedsiaforesaid in

Deed Book 14, Volume I, Page 532, conveyed to Caroline H. Daub and Walter H. Daub, her
husband. The said Walter H. Daub having died on October 9, ] 961, title to the said lot vested in
Caroline R. H. Daub absolutely.
Lot No. 32 being the same lot which Tradesmens National Bank and Trust Compapy, sole
Trustee under the Will of Jacob H. Longnecker, by its Deed dated April 11 , 1950 lVld recorded in
the Office of the Recorder of Deed as aforesaid in Deed Book 14, Volume H., Pag~ 377,
conveyed unto Caroline R. H. Daub. '
BEING the same premises which Elisabeth H. Daub Hickok and Walter H. Daub, ~xecutors of
the Last Will and Testament of Caroline H. Daub, also known as Caroline R. H. D1Ub, by their
Deed dated January 25, 1967 and recorded in the Office of the Recorder of Deeds' n and for
Cumberland County, Pennsylvania in Deed Book F-22, Page 820, granted and con eyed unto
