COMPLAINT
The Plaintiff, NOLAND COMPANY, by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit
against the Defendant to recover the sum of TWENTY-THREE THOUSAND, EIGHTEEN DOLLARS AND FORTY-NINE
CENTS ($23,018.49), along with interest thereon from January 25, 2002 upon a cause of action of which the following is a
statement:
1. The Plaintiff, NOLAND COMPANY, is a corporation having an office and place of business at 209-213
Chinquapin Road, Annapolis, MD 21401.
2. The Defendant, TIM WILBUR, is an adult individual trading and doing business as TIM VVILBUR MECHANICAL
CONTRACTING and has an office and place of business at 507 North York Street, Mechanicsburg, PA 17055.
3. On or about October 8, 1998, Defendant applied for credit with Plaintiff· A true a correct copy of the Credit
Application is hereto attached, made a part hereof and marked Exhibit "A."
4. On the dates, in the amounts, and for the pdces set forth in a true and correct copy of the Plaintiff's books of
original entry hereto attached, made a part hereof and marked Exhibit "B," and under the terms of the above referenced Credit
Agreement, Defendants became liable on certain invoices as set forth on said Exhibit "B" to the total amount of EIGHTEEN
THOUSAND, FOUR HUNDRED FOURTEEN DOLLARS AND SEVENTY-NINE CENTS ($18,414.79).

5. Due to Defendant's default in payment of said amount due and owing as aforesaid and under the terms of the
Credit Agreement attached at Exhibit "A," attorney's fees have been added to said account in the total amount of FOUR
THOUSAND SIX HUNDRED THREE DOLLARS AND SEVENTY CENTS ($4,603.70).
6. Plaintiff has frequently demanded payment from Defendant of said amount due and owing as aforesaid, but
Defendant has refused and neglected and still refuses and neglects to pay said amount of any part thereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of TVVENTY-THREE THOUSAND,
EIGHTEEN DOLLARS AND FORTY-NINE CENTS ($23,018.49), along with interest thereon from January 25, 2002.
