SHAULL EQUIPMENT AND SUPPLY COMPANY, Defendant No. (){.. - J1~ (]t'uJ~-, '-r0L~ COMPLAINT FOR CONFESSION OF JUDGMENT Plaintiff, Fulton Bank, files this Complaint pursuant to Pa. RC.P. 92951(b) for judgment by confession and avers the following: 1. Plaintiff, Fulton Bank ("Fulton"), is a Pennsylvania banking corporation with a principal location of One Penn Square, P. O. Box 4887, Lancaster, Pennsylvania 17604. 2. Defendant, Shaull Equipment and Supply Company, is Pennsylvania Corporation with a business address of 100 Market Street, Lemoyne, Pennsylvania 17043. 3. On or about February 16, 1995, Defendant borrowed from Fulton the amount of $1,000,000.00, payable on demand plus interest at the annual variable rate of 0.25% above the annual floating rate of interest designated from time to time by Fulton as its prime rate, as evidenced by a Line of Credit Note and Agreement (the "Note") A true and correct copy of the Note is attached hereto as Exhibit "A" and incorporated by reference. 1538659.1 4. The Note requires Defendant to pay a late charge of five percent (5%) of the overdue payment of principal and interest when Fulton does not receive Defendant's monthly payment within fifteen (15) days ofthe date that the payment is due. 5. The Note authorizes confession of judgment against Defendant for all amounts due under the Note plus continuing interest, costs of the proceeding and a reasonable attorneys' fee equal to 15% of the sum of the principal plus interest for which judgment is confessed. 6.
