The plaintiff is a corporation duly organized and existing under the laws of the state of Pennsylvania, with its principal place of business at 2335 Locust Lane, Harrisburg. Pennsylvania. 2. The defendant, Century 21 Piscioneri Realty, Inc. is a corporation licensed to engage in the business of selling real estate in the state of Pennsylvania, with its principal place of business at 3315 Market Street, Camp Hill, Pennsylvania. 3. The defendant, Diane H. Leslie, is an individual licensed to sell real estate in the state of Pennsylvania out of the office of Century 21 Piscioneri Realty, Inc. at 3315 Market Street, Camp Hill, Pennsylvania. 4. The defendant, Craig A. Leslie, is an individual licensed to sell real estate in the state of Pennsylvania out of the office of Century 21 Piscioneri Realty, Inc. at 3315 Market Street, Camp Hill Pennsylvania. 5. The defendants were engaged by the plaintiff to sell Lot 34 on Woodbume Road, Lewisberry, Pennsylvania, on which the plaintiff built a home known and numbered as 655 Woodbume Road. 6. Settlement was to be on or before August 16, 2000. 7. Prior to the original settlement date of August 16,2000, the defendants prepared an agreement extending the settlement date. The plaintiff's signature was obtained on the agreement, but the defendants failed to obtain the signatures of the buyers, unbeknownst to the plaintiff. 8. Upon the original settlement date of August 16, 2000 passing, the plaintiff, to his surprise, was advised by the buyers that the contract had expired and that they did not intend to go through with the sale unless their demands for improvements and changes to the property were met. These demands were new and not included in the original agreement. 9. Settlement was eventually held on the property, but not before the plaintiff, in an attempt to minimize his losses was forced, at his expense, to do the following: a. additional and expanded preparation for landscaping $ 2740.00 b. foundation work 1800.00 c. excavation and removal of large boulders and trees 9751.45 d. extra top soil 1519.00 e. landscaping 720.00 f monetary credit to buyers for future extension of driveway 797.00 g. payment for buyers moving expenses 400.00 Total $17727.45 10. When the defendants discovered their mistake of failing to get the buyers' signatures on the extension agreement, they promised the plaintiff that if he complied with the additional demands of the buyers they would waive their commission of $5250 on the sale and the payment due them by the plaintiff of the construction service fee in the amount of $3877.37. These promises were not kept by the defendants, and the aforesaid amounts were charged the plaintiff and deducted from his sale proceeds at settlement. 11. The failure of the defendants to adhere to the accepted standard of care in getting the contract extension executed before the expiration date was the direct and proximate cause of the economic losses suffered by the plaintiff. WHEREFORE, Plaintiff demands judgment against the defendants in the amount of $27,524.52, and for punitive damages in an amount to be determined by the trier of fact, and costs. Count II 12. Paragraphs 1-6 are incorporated herein by reference. 13. On or about November 30, 1999, Craig A. Leslie and Diane H. Leslie convinced the plaintiff to refinance the purchase of Lot 34, because they did not like dealing with the then owner of the lot, Harry H. Fox, Jr. Because the plaintiff was paying no interest to Harry H. Fox, Jr., the Leslies promised the plaintiff that they would pay for any costs, including interest, associated with refinancing the lot. The plaintiff was never paid the costs in the amount of$1918.00, which he incurred. 14. The defendants have breached their promise to reimburse the plaintiff.
