STIPULATION AGAINST LIENS
THIS AGREEMENT made this '~day of December, 2005 by and
between Iacono Company, hereinafter referred to as Contractor,
AND
Gerald A. Dolinish and Joyce R. DOlinish, hereinafter referred to
as Owner, whereby the contractor undertook and agreed to erect and
construct a single family dwelling on the certain lot of ground
situate in Monroe Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #277 Kuhn Road,
White Rock Acres, Boiling Springs, PA 17007.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL that certain tract of land situate in Monroe Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a plan prepared by Michael C.
D' Angelo, R. S. and recorded in the Office of the Recorder of Deeds for Cumberland
County in Plan Book 39, Page 25.
BEGINNING at a point on northern right of way line of Cur-Lee Lane at comer
of Lot No. 276 Section M; thence along northern right of way line of Cur-Lee Lane,
South 83 degrees 42 minutes 00 seconds West 162,12 feet to a point; thence by a curve to
the right creating the intersection of Cur-Lee Lane and Kuhn Road having a radius of
25.00 feet, an arc distance of 32.72 feet on a chord bearing of North 58 degrees 47
minutes 56 seconds West to a point; thence along the eastern edge of Kuhn Road North
25 degrees 10 minutes 00 seconds West 167.36 feet to a point; thence along Lot No, 278
North 68 degrees 40 seconds 39 seconds East 238.75 feet to a point; thence along Lot No,
276 South 06 degrees 03 minutes 45 seconds East 242,07 feet to a point, the place of
BEGINNING.
SUBJECT lot shall be used solely for a building lot and shall not be used in any
manner as a right of way, easement or other permitted access for purpose of ingress,
egress or regress to any other adjoining tract or tracts of real property which are not a part
of White Rock Acres Subdivision. Buyer will be responsible for any and all costs that
would be incurred by Seller, if any attempt is made to violate this provision.
EXCEPTING AND RESERVING unto the Grantor, its successors and assigns
all minerals, clays and sand beneath the surface of the ground. This provision shall not
be construed to give the Grantor or its successors or assigns the right to mine or remove
any minerals, clay or sand from the lot herein conveyed.
ALSO EXCEPTING AND RESERVING unto the Grantor, its successors and
assigns, all gas and oil rights beneath the surface of the ground.
This provision shall not be construed to give the Grantor or its successors and
assigns the right to remove any gas or oil from the lot herein conveyed.
