STIPULATION AGAINST LIENS

THIS AGREEMENT made the ~2th day of January, 2006
by and between
Deimler Homes
hereinafter referred to as Contractor,
Dwayne A. Deimler and Ralph T. Jacques. Sr.
AND
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, in 177 Church Road, Penn Township, Cumberland County, Pennsylva-
nia, more particularly described in attached exhibit UA",
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of ONE Dollar to it in hand paid by
Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned
in the agreement aforesaid, for themselves and their subcontractors, and all parties
acting through or under them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by
them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said
Contractor, for themselves, their subcontractors and others under them hereby expressly
waive and relinquish the right to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this instrument, waiving the
right of lien, shall be an independent covenant.

Commonwealth of Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point at lands now or formerly of Jonathan G. and Sherri M. Ritchey; thence
along the same North eighty (80) degrees fifty-four (54) minutes thirty-two (32) seconds West a
distance of two hundred seventy-six and seventy-eight hundredths (276.78) feet to a point at
lands now or formerly of Earl C. and Patricia A. Thwnma; thence along the same North twenty-
eight (28) degrees zero (00) minutes zero (00) seconds East a distance of five hundred fifty-two
and forty-eight hundredths (552.48') feet to a point at Lot #3 on the hereinafter mentioned
subdivision plan; thence along the same South fifty-two (52) degrees one (01) minutes nine (09)
seconds East a distance of two hundred seventy-three and ninety-nine hWldredths (273.99') to a
point at Lot #2 on the hereinafter mentioned subdivision plan; thence along the same South
twenty-nine (29) degrees ten (10) minutes ten (10) seconds West a distance of four hWldred
fourteen and nine hWldredths (414.09) to a point and Place of BEGINNING.
BEING Lot #1, Containing 128,374 square feet (2.95Acres) on the Subdivision plan for James E.
and Dorothy A. Miller prepared by Madden Engineering Services, Inc. and recorded in
Cumberland County Records in Plan Book 90 Page 63.
BEING THE SAME PREMISES which Jerry W. Swartz, married man by his
Deed- dated ~'->-A'" \c:::., 2006 and about to be recorded in the
Office of the Reco~~r of Deeds in and for Cumberland County,
pennsylvania, granted and conveyed unto Dwayne A. Deimler and
Ralph T. Jacques, Sr. Mortgagors herein.
