STIPULATION AGAINST LIENS
WHEREAS, Patsy A. Wienken of2858 Myrtle Drive, Mechanicsburg, Pennsylvania
("Owner"), is about to execute contemporaneously herewith, a contract with Farinelti
Construction, Inc, on Kacey Court. Suite 101, Mechanicsburg, Pennsylvania 17055
("Contractor") for the construction of certain improvements to said reaJ estate situate upon a lot
of land known lIS Lot No. 18 llS shown on the Arborfield Subdivision Plan as recorded in Plan
Book 90, Page 23, Upper Allen Township, Cumberland County, Pennsylvania and more fully
described in attached Exhibit" A."
NOW, THEREFORE, before any authority had been given by Owners to Contractor to
commence work on said facilities or purchase materials fur same, in consideration of making of
the above-described Contract with Owners, and in further consideration of One ($1,00) Dollar
paid to Contractor by Owners, the receipt whereof is hereby acknowledged, it is agreed that no
liens or claims shall be filed or maintained against the Owners' property and the land
above-describcd by the Contractor or any of its subcontractotS, or by any of the materialmen or
workmen, or any other person acting through or under them, for or on account of any labor or
materials purchllSed, or ex:tra labor or materials purchased for. towards, in or abut the erection,
constnlction, design and improvement of said facilities, under said contract or otherwise, the
right to have, file lIIld maintain such liens or claims against the facilities and the land
above-described, being hereby cxpressly waived by the Contractor for itself, its subcontractotS,
all materialmen, or workmen lIlId other acting through or under them.

ALL THAT CRRT AIN LOT or pateel ofland situate in Upper Allen Township, Cumberland
County, PelUlSylvania and more particularly described as Lot #18 of the Arborfield Subdivision
Plan, as indicated on a plan dated July 30, 2004 last revised November 5, 2004 by Alpha
Consulting Engineers, Inc. and recorded in Plan Book 90, Page 23 of the public records of
Cumberland County, Pennslyvania being more particularly described as follows:
BEGINNING at a point on the northern right-oC-way of Arbor Court at the common property
corner of Lot 18 and Lot 19; said point being located North 60 degrees 32 minutes 25 seconds
West a distance of 803.05 feet from a concrete monument located on the western right-of-way of
Gettysburg Pike; thence along Lot 19 North 20 deiTees 40 minutes 16 seconds East a distance of
37.42 feet; thence along the same North 08 degrees 18 minutes 31 seconds East a distance of
180.53 feet; thence along lands now or formerly of Nelson 1. and Esther Wingert South 47
degrees 19 minutes 00 seconds East a distance of 108.44 tilet (incorrectly labeled on aforesaid
plan as 92.47 feet); thence along Lot 17 South 16 degrees 26 minutes 59 seconds West a distance
of 154.06 feet; thence along the same South 05 degrees 44 minutes 08 seconds West a distance
of 15.00 feet to a point on the northern right-of-way of Arbor Court; thence along the northern
right-of-way of Arbor Court by a c\IlVe to the left having a radius of225.00 feet, an arc length of
33.74 feet, a chord bearing of North 88 degrees 33 minutes 39 seconds West and a chord length
of33.71; thence along the same by a curve to the right having a radius of 25.00 feet, an are
length of21 ,68 feet, a chord bearing of North 68 degrees 00 minutes 38 seconds West and a
chord length of21 ,01 feet; thence along the same by a curve to the left having a radius of 55 feet,
