HomeMy WebLinkAbout02-0969STIPULATION AGAINST LIENS THIS AGREEMENT made the ~-$ of ~~ , 2002, by and between THE McNAUGHTON COMPANY, Contractor, STEPHEN J. KOSMAN and BONNIE L. KOSMAN, husband and wife, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Hampden Township, Cumberland County, Pennsylvania, more particularly described in attached Exhibit "A", also referred to as 512 Jacob Lane, Mechanicsburg, Pennsylvania. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to THE McNAUGHTON COMPANY in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. WITNESS our hands and seals this ~-- day of Signed, Sealed and Delivered in the Pr~nce 1 of T~- Md~.G'}~TON, COMPAN~ (Seal) (Seal) (Seal) EXHIBIT "A" ALL THAT CERTAIN piece, parcel or lot of land, together with improvements, situated in Hampden Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Southern right-of-way line of Jacob Lane (50.00 feet wide), said point being located at the Northeastern corner of Lot No. 216; thence along said right-of-way line on the arc of a circle, curving to the left, having a radius of 175.00 feet, and an arc length of 19.74 feet, to a point along same; thence South 86 degrees 59 minutes 07 seconds East, for a distance of 77.50 feet, to a point at the Northwestern corner of Lot No. 218; thence along the Western boundary line of Lot No. 218, South 17 degrees 45 minutes 46 seconds West, fo~ a distance of 146.82 feet, to a point on the Northern boundary line of Lot No. 221; thence along said Northern boundary line of Lot No. 221 South 83 degrees 02 minutes 34 seconds West, for a distance of 94.00 feet, to a point at the Southeastern corner of Lot No. 209 of Phase VI; thence along said Lot No. 209 of Phase.VI, North 47 degrees 15 minutes 27 seconds West, for a distance of 30.00 feet, to a point at the Southeastern corner of Lot No. 216; thence along the Southern boundary line of Lot No. 216, North 24 degrees 43 mintues 41 seconds East, for a distance of 150.91 feet, to a point and the place of BEGINNING. CONTAINING approximately 16,138.00 square feet of land, has an addres of 512 Jacob Lane, Mechanicsburg, Pennsylvania 17055, and is known and .numbered as Lot No. 217 on the Final Subdivision Plan for Good Hope Farms South - Phase VII, which is recorded in Cumberland County in Plan Book 83, Page 64. UNDER AND SUBJECT TO: (a) Any and all easements, licenses, leases, exceptions, reservations, covenants, agreements, conveyances and restrictions which affect the premises and are visible by inspection of the premises. (b) Any and all easements, licenses, leases, exceptions, reservations, covenants, agreements, conveyances and restrictions contained in any and all prior documents, agreements, instruments, deeds, grants and conveyances affecting the premises. (c) The Declaration of Covenants and Restrictions, recorded in Cumberland County in Misc. Book 679, Page 1174 as may be applicable to the above described property.
