This Petition, filed by The Law Offices of Barbara A. Fein, P.c., Barbara A. Fein, Esquire,
on behalf of The Bank of New York, as Trustee for the Holders of the EQCC Asset Backed
Certificates, Series 2001-1 F, the foreclosing mortgagee named in a Civil Action -- Mortgage
Foreclosure filed in Cumberland County Court of Common Pleas under Docket No. 05-5711 Civil
Term, entitled The Bank of New York, as Trustee for the Holders of the EOCC Asset Backed
Certificates, Series 2001-1F v. Jacob T. Hodge and Dolores G. Hodge, instituted on November 3,
2005, respectfully submits that:

1. Title to real property situated at 849 West Louther Street, Carlisle, North Middleton
Township, Cumberland County, vested with Jacob T. Hodge and Delores G. Hodge, Husband and
Wife, by Deed dated and recorded on August 31, 1979, by the Cumberland County Recorder of
Deeds in Deed Book Volume 28-A, Page 220.
2. By instrument dated May 26, 2000, and recorded on May 31, 2000, the Hodges
mortgaged the real estate above described, and the Mortgage Instrument was recorded by the
Cumberland County Recorder of Deeds at Record Book 1615, Page 198. A copy of the Mortgage
is appended hereto and incorporated herein by reference as Exhibit "P-1 ".
3. To the best of this Petitioner's knowledge, information and belief, Delores G. Hodge died
an intestate resident of Cumberland County on October 1,2002, as evidenced by Death Certification
No. 106140. A true and correct certified copy of said Death Certificate can be produced at the time
of the Citation hearing.
4. By operation of law, Decedent Delores G. Hodge's interests in the real estate above
described passed to her surviving Tenant-by-the-Entirety, Jacob T. Hodge, Sr. Similarly, her
financial obligations under the mortgage above described also passed to her surviving obligor, Jacob
T. Hodge, Sr.
5. To the best of this Petitioner's knowledge, information and belief, Jacob T. Hodge, Sr.,
died an intestate resident of Cumberland County on October 25, 2005, as evidenced by Death
Certification No. 104331. A true and correct certified copy of said Death Certificate can be
produced at the time of the Citation hearing.
6. According to the Obituary which appeared in the Carlisle "Sentinel" on November 10,
2005 (a copy of which is appended hereto and incorporated herein by reference as Exhibit "P-2"),
the Decedent, Jacob T. Hodge, Sr. "aJk/a Jake Hodge", was survived by four (4) adult children.
7. According to the Obituary, Jacob T. Hodge, Jr. "alk/a Spike Hodge" is the Decedent's son,
and the Informant listed at Paragraph 20a on his Death Certificate. To the best of this Petitioner's
knowledge, information and belief, and upon confirmation of George F. Douglas, III, Esquire, with
Saidis, Shuff, Flower & Lindsay (attorney for Spike Hodge), Spike Hodge resides at 43 West
Baltimore Street, Carlisle, P A 17013.
8. According to the Obituary, Sheritta A. Richardson was the Decedent's daughter and
residing in Carlisle, P A. To the best of this Petitioner's knowledge, information and belief, and
upon confirmation of George F. Douglas, III, Esquire, with Saidis, Shuff, Flower & Lindsay
(attorney for Spike Hodge), Sheritta A. Richardson resides at 121 Partridge Circle, L6D, Carlisle,
PA 17013-8748.
9. According to the Obituary, Pamela V. Hodge was the Decedent's daughter and residing
in Carlisle, P A. To the best of this Petitioner's knowledge, information and belief, and upon
confirmation of George F. Douglas, III, Esquire, with Saidis, Shuff, Flower & Lindsay (attorney for
Spike Hodge), Pamela V. Hodge resides at 420 Franklin Street, Carlisle, PA 17013-1858.
10. According to the Obituary, Valorie L. Brooks was the Decedent's daughter and residing
in Dover, DE. To the best of this Petitioner's knowledge, information and belief, and upon
confirmation of George F. Douglas, III, Esquire, with Saidis, Shuff, Flower & Lindsay (attorney for
Spike Hodge), Valorie L. Brooks resides at 106 Red Oak Drive, Dover, DE 19904-2300.
11. As plead in the verified Mortgage Foreclosure pleading above described, this Petitioner
submits that effective November 15,2005, the sum necessary to satisfy the mortgage obligation in
full was $96,957.38.
12. To the best of Petitioner's knowledge, information and belief, none ofthe Decedent's
heirs at law have sought Letters of Administration to probate the Decedent's estate.
13. This Petitioner will be unable to prosecute its pending Mortgage Foreclosure action
due to the heir's failure and/or refusal to seek Letters of Administration to have a personal
representative appointed.
14. Despite the undersigned counsel for the Petitioner's efforts to contact the Decedent's
heirs by letter sent to all four of them on December 23, 2005, the heirs have been wholly
unresponSIve.
WHEREFORE, this Petitioner respectfully requests that a Citation be awarded, directed to
Barbara A. Fein, Esquire, to show cause why this Petitioner or its Nominee should not be granted
Letters of Administration for suit purposes only.
