of Cumberland, Pennsylvania
WHEREAS, Carole F. Gibbons of 4551 Sequoia Drive, Apt. C276,
Harrisburg, Pennsylvania, is about to execute contemporaneously herewith, a
contract, with Farinelli Construction Inc. of Mechanicsburg, Pennsylvania, for the
erection of a one story residential building upon a lot of land situate
in Upper Allen Township, Cumberland County, Pennsylvania, being more
particularly bounded and described as follows:
BEGINNING at a point on the southern legal right-of-way line of Lisburn
Road (L.R. 416) at the northwest corner of Lot NO.1 on the hereinafter
described Final Subdivision Plan; thence along the western line of said Lot
NO.1 the following two (2) courses and distances: (1) South 23 degrees
43 minutes 35 seconds West a distance of 200 feet; and (2) South 11
degrees 16 minutes 25 seconds East a distance of 160.00 feet to a point
at the northeast corner of Lot No.3 on the hereinafter described Final
Subdivision Plan; thence along the northern line of said Lot NO.3 South
86 degrees 33 minutes 30 seconds West a distance of 508.70 feet to a
point on the eastern legal right-of-way line of Myrtle Drive (private road);
thence along the eastern right-of-way line of Myrtle Drive by a curve to the
right having a radius of 325.00 feet a distance of 481.31 feet; thence
continuing along Myrtle Drive by a curve to the left having a radius of
175.00 feet a distance of 109.34 feet; thence continuing along the eastern
right-of-way of Myrtle Drive (private road) by a curve to the right having a
radius of 25 feet a distance of 39.27 feet to a point on the southern legal
right-of-way line of Lisburn Road (L.R. 416); thence along the southern
legal right-of-way line of Lisburn Road (L.R. 416) South 66 degrees 16
minutes 25 seconds East a distance of 353.81 feet to a point at the
northwest corner of Lot No. 1 on the hereinafter described Final
Subdivision Plan, the point and place of BEGINNING.
CONTAINING 5.007 acres.
BEING Lot No.2. Final Subdivision Plan Ford Farm Road-Plan No.2,
recorded in the Office of the Recorder of Deeds of Cumberland County in
Plan Book 57, Page 131.
BEING THE SAME PREMISES Miles J. Gibbons, Jr. and Carole F.
Gibbons, husband and wife, by their deed dated October 29, 2001 and
recorded October 31, 2001 in the Office of the Recorder of Deeds in and
for Cumberland County, Pennsylvania in Deed Book 248, Page 4917
granted and conveyed unto Carole F. Gibbons.
NOW, February ;;.d, 2002, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by
the said Carole F. Gibbons to the said Farinelli Construction Inc. to commence
work on the said building, or purchase materials for the same in consideration of
the making of the said contract with Carole F. Gibbons and the further
consideration of One Dollar, to Farinelli Construction Inc., it is agreed that no lien
shall be filed against the building by the contractor, or any sub-contractor, nor by
any of the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the erection of
said building, the right to file such liens being expressly waived.
