MORGAN on behalf of her mmor daughter, JADYN REBECCA McCLOSKEY, by and through her attorneys, Irwin & McKnight, under the Act of December 16, 1982,54 Pa.CS.A. ~ 702, as amended, respectfully represents the following: 1. Julie A. Morgan is an adult individual whose principal residence is 199 Faith Circle, Carlisle, Cumberland County, Pennsylvania 17013. 2. Julie A. Morgan is the birth mother of the Petitioner, JADYN REBECCA McCLOSKEY, born February 11, 1998. A true and correct copy of the Petitioner's Birth Certificate is attached hereto and incorporated herein as Exhibit "A." 3. Julie A. Morgan was recently married on November 12, 2005, and adopted the surname of her husband, Morgan. A true and correct copy of the Certification of Excerpts from Marriage License Record of the Register of Wills of Cumberland County, Pennsylvania is attached hereto and incorporated herein as Exhibit "B." 4. Since her birth, Petitioner has carried her mother's maiden surname, McCloskey. 5. Julie A. Morgan has primary physical custody and sole legal custody of the Petitioner in accordance with a Stipulation for Custody and Order of Court docketed in the Court of Common Pleas of Cumberland County, Pennsylvania at Docket No. 2000 - 2475. A true and correct copy of the Order of Court dated May 3, 2002, and the Stipulation for Custody signed by the natural parents is attached hereto and incorporated herein as Exhibit "c" 6. There are currently no scheduled or contemplated modification proceedings with regard to the above-referenced custody proceedings. 7. For the majority of her life, Petitioner has been raised by and lived with her natural mother. 8. During the last five (5) years, Petitioner has resided with her natural mother at 199 Faith Circle, Carlisle, Cumberland County, Pennsylvania, 288 Redwood Lane, Carlisle, Cumberland County, Pennsylvania, and 7073 Carlisle Pike #138, Carlisle, Cumberland County, Pennsylvania. 9. The natural mother and natural father of the Petitioner were never married. 10. In the past, Petitioner's natural father has exercised his right of partial physical custody only on a limited basis. 11. The natural father has failed and refused to contribute to the financial support of the Petitioner. 12. Petitioner's natural father is currently more than $11,000.00 in arrears for his child support obligations for Petitioner, and upon information and belief has at least two (2) other open support cases on which he is also several thousand dollars in arrears. 13. In addition, the natural father has been charged and/or convicted of numerous crimes and offenses. 14. Petitioner and her mother desire to make Petitioner's surname consistent with the surname of Petitioner's mother, brother, step-brother and step-father. 2 15. The requested relief will assist to protect Petitioner from psychological and emotional confusion which may result from the child and parent having two different surnames. 16. The Petitioner's name would be changed from her mother's maiden surname, JADYN REBECCA McCLOSKEY, to her mother's new married surname, JADYN REBECCA MORGAN. 17. Petitioner requests that this Court waive the requirement for official searches of the proper offices of the county wherein Petitioner resides on the grounds that the subject of this petition is a minor and that there are no judgments, decrees, or any other like character of record against the Petitioner. ] 8. The best interests and permanent welfare of the child requires that the Court grant the Petitioner's request as set forth above. WHEREFORE, Petitioner requests this Honorable Court, pursuant to under the Act of December 16, 1982,54 Pa.CS.A S 702, as amended, for the following: a. Fix a hearing on this Petition; b. Direct that notice of this Petition be given to the natural father and by publication; and c. Enter a decree changing the Petitioner's name from JADYN REBECCA McCLOSKEY to JADYN REBECCA MORGAN.
