D&,- toP) G'vLLt-~ RITE AID CORPORATION, CIVIL DIVISION - LAW Defendant COMPLAINT The Plaintiff, COLLECTOR'S GALLERY, DIVISION OF WARWICK PUBLISHING COMPANY, by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of FIVE THOUSAND DOLLARS ($5,000.00), along with interest thereon from June 16, 2005, upon a cause of action of which the following is a statement: 1. The Plaintiff, COLLECTOR'S GALLERY, DIVISION OF WARWICK PUBLISHING COMPANY, is a corporation organized and existing under the laws of the State of Illinois, having its principal office and place of business at 2601 East Main Street, St. Charles, Illinois 60174. 2. The Defendant, RITE AID CORPORATION, is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, having its principal office and place of business at 30 Hunter Lane, Camp Hill, Cumberland County, Pennsylvania 17011. 3. In 2004, Plaintiff, at the special instance and oral request of the Defendant, sold and delivered holiday goods, wares and merchandise totaling One Hundred Thirty Two Thousand Seven Hundred Thirty Two Dollars and Sixty Cents ($132,732.60). 4. The prices charged for said goods, wares and merchandise were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant orally promised and agreed to pay to F:IUSERIROBINICCP&DJ CMPSICCP COMPLAINTS\31818.wpd:28Nov05 Plaintiff. 5. Thereafter, Defendant took an unauthorized holdback from their June 16, 2005 payment in the total amount of Five Thousand Dollars ($5,000.00) as set forth on Plaintiff's September 1,2005 Statement of Account and Defendant's June 16, 2005 Statement of Account, collectively attached hereto, marked Exhibit "A" and made a part hereof 6. The balance due and owing by Defendant to Plaintiff is the sum of Five Thousand Dollars ($5,000.00), as appears by Plaintiff's Statement hereto attached, marked as Exhibit "8" and made a part hereof. 7. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendant'. 8. Plaintiff frequently demanded paymentfrom Defendant of said amount due and owing as aforesaid, but Defendant refused and neglected and still refuses and neglects to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of FIVE THOUSAND DOLLARS ($5,000.00), together with interest thereon from June 16, 2005. Respectfully submitted, Robert D.
