STIPULATION AND AGREEMENT
THIS STIPULATION AND AGREEMENT entered into this ~ day of
/~,~'A:'~W' , 2002, by and between GLENDA S. HOOPERT (hereinafter referred to as
"Mother") and MARK L. HOOPERT, II (hereinafter referred to as "Father").
NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, the Father and Mother are the natural parents of three (3) children,
namely, Mark L. Hoopert, III (Age 11 years), Courtney M. Hoopert (Age 8 years) and
Glenn T. Hoopert (Age 5 years); and,
WHEREAS, the parties wish to enter into an agreement relative to the custody,
partial custody, and support of the children.
NOW, THEREFORE, in consideration of the mutual covenants, promises and
agreements as hereinafter set forth and intending to be legally bound, the parties
hereto agree as follows:
1. The Mother and Father shall have joint legal custody of the children.
2. The Mother shall have primary physical custody of the children.
3. The Father shall have temporary physical custody of the children at such
times as set forth herein or as otherwise mutually agreed by the parties:
A. Father shall be responsible for contacting Mother by telephone to
inform her of his work schedule and time off dudng which he seeks to have
visitation with the children;
B. Father shall be required to provide one week notice to Mother of
his intention and desire to have visitation;
C. Said visitation shall occur with Mother providing transportation of
the children to and from the residence of the Father;
D. Father and Mother shall share visitation on the respective birthdays
of the children as agreed by the parties;
E. Father may have additional visitation during his vacation days from
work, provided he give the Mother one month notice of his vacation days and his
intention to have additional visitation;
F. Fathers visitation on holidays shall be arranged by the agreement
of the parties, as the Father's employment schedule may vary from holiday to
holiday and no specific schedule can be determined until one month prior to
each holiday occurring.
G. Father shall give Mother one month's notice of his intention,
availability and desire to enjoy holiday visitation with the children.
4. Both parties shall refrain from consuming alcohol and shall not be under
the influence of alcohol during his visitation with the children.
5. Both parties shall have reasonable telephone contact with the children
while the children are in the otheYs custody.
6. Both parties shall keep the other advised immediately relative to any
emergencies concerning the children and shall further take any necessary steps to
insure that the health, welfare and well being of the children is protected.
7. The parties shall do nothing that may estrange the children from each
other or hinder the natural development of the children's love or affection for the other
party.
8. Father shall pay Mother a total of $558.17 per month in support, which
amount is to be allocated as follows:
a. Father shall pay $499.98 per mOnth in child support, which amount
includes Fathers contribution to the childcare costs for the children.
b. Father shall also pay $58.20 to Mother on a monthly basis to
reimburse Mother for the cost of his health insurance coverage which is
deducted from Mothe~s wages by her employer until such time as the parties are
divorced, or until Father secures his own medical coverage for himself,
whichever event occurs first.
9. All support payments hereunder shall be collected from the Father by
means of a wage attachment and payable through the Cumberland County Domestic
Relations Office and / or Pa S.C.D.U. as directed by DRO.
10. Any modification or waiver of any of the provisions of this agreement shall
be effective only if made in writing and only if executed with the same formality of this
agreement.
11. The parties agree that in making this agreement there has been no fraud,
concealment, overreaching, coercion or other unfair dealing on the part of the other.
12. The parties desire that this agreement be made an order of Court through
the Court of Common Pleas of Cumberland County, and further acknowledge that the
Court of Common Pleas of Cumberland County has jurisdiction over the issue of
custody of the parties' minor children and shall retain such jurisdiction should
circumstances change and either party desire further or require further modification of
said Order.
IN WITNESS WHEREOF, the parties hereto, intending to be legally bound by the
terms hereof, set forth their hands and seals the day and year herein set forth.
