COMPLAINT
I. Plaintiff is a corporation having oftices in 6750 MILLER RD.
BRECKSVILLE, OH 44141-0000.
2. Defendants arc adult individuals residing at 1875 LAMBS GAP RD
MECHANICSBURG,P A 17050 AND 209 FOUR SEASONS LN
ENOLA,PA 17025.
3. On or about OCTOBER 252000. Defendants duly executed a FIXED RATE
PROMISSOR Y NOTE AND SECURITY AGREEMENT (hereinafter the "Contract") in favor of
NA TlONAL CITY BANK, a true and con'ect copy of said Contract is attached hereto, marked as Exhibit
"1" and made a part hereof.
4. Pursuant to said Contract, Defendants took possession of the vehicle more particularly
identified in the Contract as a 1994 PL YMOUTH GRAND VOYAGER.
5. Pursuant to the terms and conditions provided by the Contract, the Contract was assigned
from NA TJONAL CITY BANK to Plaintiff
6. Plaintiff avers that Defendants is in default of the Contract by having not made payment to
Plaintiff as promised, thereby rendering the entire balance immediately due and payable.
7. Plaintiff avers that a balance of $7634.08 is due from Defendants as of DECEMBER
13.2005.
8. Plaintiff avers that the Contract between the parties provides that Plaintiff is entitled to
interest at the rate of 12.22% per annum.
9. Plaintiff avers that the Contract between the parties provides that Defendants will pay
Plaintiffs reasonable attorneys' fees.
10. Plaintitl avers that such attorneys' fees amount to $1000.00.
11. Although repeatedly requested to do so by Plaintiff: Defendants have willfully j~liled anc1lor
refused to pay the principal balance, attorneys' fees, interest, or any part thereof to Plaintiff.
WHEREFORE, Plaintiff demands judgment against Defendants. IRIS J FOLCKERMER AND
JEANI L FLEMING, jointly and severally, in the amount of $7634.08 with continuing interest thereon at
the Contract rate of 12.22% per annum from DATE OF JUDGMENT, plus attorneys' fees of $1000.00
and costs.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED
SHALL BE USED FOR THAT PURPOSE.

AND NOW comes Iris J. Folckemer one of the Defendants named in the above matter,
and files the following preliminary Objections to Plaintiff's Complaint:
MOTION TO STRIKE
1. Plaintiff's Complaint lists Jearn Fleming as a Defendant.
2. Jeani Fleming died on 15 September 2004 and Plaintiff, by its agents and
representatives, is aware of the death of Jeani Fleming.
3. Plaintiff's Complaint is improper in that it has been brought against a decedent and
not the personal representative of the decedent.
4. Plaintiff's Complaint, by improperly bringing an action against a deceased person
and not a personal representative of that deceased person, impairs and obstructs the rights of
the Defendant Iris J. Folckemer to make a cross claim, for contribution or otherwise, against
her co-defendant in this action.
5. Plaintiff's Complaint is contrary to the law of Pennsylvania and the rules of civil
procedure. Plaintiff's Complaint should be stricken for that reason.
6. The necessary party to this action is the personal representative of Jeani Fleming.
Plaintiff has failed to join that necessary party in this action.

WHEREFORE, Iris J. Folckemer moves this court to strike Plaintiff's Complaint for
failure to conform to law or rule of court and, further, to strike Plaintiff's complaint because it
fails to join a necessary party.
