THIS AGREEMENT made the q dayof\.JlAl\\.l€lVj ,by and between
DOUBLE BB, INC. DBA: ZIMMERMAN HOMES AND RENOVATIONS,
5760 Old York Road, New Oxford, PA 17350,Hereinafter referred to as Contractor,
AND
CLAUDIA A. JONES 1342 Keyes Road Ramona, CA 92065, hereinafter
referred to as Owner, whereby the former undertook and agreed to erect and construct a
SINGLE FAMILY DWELLING on that certain lot of ground situate in
965 Oxford Road New Oxford, Adams County, Pennsylvania, 17350 (SEE ATTACHED
LEGAL DESCRIPTION)
NOW THEREFORE, THIS AGREEMENT WITNESSTH: That the said Contractor,
for and in consideration of the sum of ($1.00) Dollar to DOUBLE BB, INC. DBA:
ZIMMERMAN HOMES AND RENOVATIONS in hand paid by Owner, the receipt
whereof is hereby acknowledged, and further consideration mentioned in the agreement
aforesaid, for themselves and their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanics liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished by them or any of them
under said contract or otherwise, for, towards, in, or about the erection and construction
of the said buildings on the lot above the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and relinquish the right to
have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right oflien, shall be an independent
covenant.

ALL THAT CERTAIN described lot of ground, situate in MT. PLEASANT TOWNSHIP, Adams County,
Pennsylvania, bounded and described as follows:
BEGINNING at a point in the center of Oxford Road (SR. 00104) and Lot No.5; thence along Lot No.5 North 48
degrees 42 minutes 18 seconds East; 518.80 feet to a point at Lot No.1; thence along Lot NO.1 South 41
degrees 17 minutes 42 seconds East, 209.99 feet to a point at Lot No.2; thence along Lot No.2 South 48
degrees 42 minutes 18 seconds West, 517.31 feet to a point at the center of Oxford Road (S.R. 00104); thence
along and through Oxford Road (S.R. 00104) North 41 degrees 17 minutes 42 seconds West, 114.83 feet to a
point thence continuing along the same by a curve to the left with a radius of 3.029 feet and whose chord
bearing is North 41 degrees 43 minutes 19 seconds West, 45.17 feet for a length of 45.17 feet to a point; thence
continuing along the same by a curve to the left whose radius is 3,029 feet and whose chord bearing is North 42
degrees 37 minutes 20 seconds West, 50.01 feet for a length of 50.01 feet to the point and place of
BEGINNING.
CONTAINING 2.4949 acres gross and identified as Lot No.3 on a Plan of Lots entitled Skyview Estates as
recorded in the Office of the Recorder of Deeds in and for Adams County, Pennsylvania on June 27, 2005 in
Plan Book 88, page 76.
SUBJECT to the following restrictions:
1. No trailer or mobiie home (inciuding a double-wide) shall be erected or permitted to remain on this lot,
temporary or permanently, nor shall any residence of a temporary character be permitted.
2. Any dwelling constructed on any lot shall contain the minimum square footage of living area of 1200 square
feet, exciuding garage and basement areas which shall not qualify for inclusion in the aforementioned square
footage.
