RELEASE OF MECHANICS' LIEN
WAIVER OF MECHANICS' CLAIM
THE UNDERSIGNED, SKELLY AND LOY, INC. (hereinafter "Contractor") for and in
consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged. does for itself. its respective
successors and assigns remise. release and waive. to and in favor ofVISAGGIO'S. INC.,
Owner of the below described property. its successors and assigns, said Contractor's right under
the Meehanies' Lien Law of 1963. Act of August 24. 1963, P.I.. 1175, No. 497 (49 P.S. ~ 1101,
et scq.) as amended, to file or enter on record any mechanics' lien or liens, mechanics' claim or
claims on or against:
ALL THAT CERTAIN piece or parcel of land situate in the Township of Silver Spring,
County of Cumberland and State of Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a nail at the intersection of the center linc of Route 944, known as the
Wertzvillc Road, \vith the center line of Towllship Road 1-594, kno\\'n as the Miller's Gap Road;
thence by the center line of the Miller's Gap Road, North 2 degrees 44 minutes West, a distance
of four hundred fifty-six and forty-nine one-hundredths (456.49) feet to a spike; thence by lands
now for tormerly of Joseph Cekovich et ux. North 82 degrees 53 minutes East, a distance of four
hundred sixty and ninety-four (me-hundredths (460.94) feet to a point; thence by lands now or
tormerly of Vogelsong. South 7 degrees 24 minutes 30 seconds East, a distance offour hundred
tifty-five and eighteen one-hundredths (455.18) feet to a point in the center line of the WcrtzviJIc
Road; thence by the center line of the Wertzville Road, South 82 degrees 53 minutes West, a
distance of four hundred ninety-eight and fourteen one-hundredths (498.14) feet to a nail, the
place of BEGINNING.
CONT AINING five (5) acres as shown on the Plan datcd February 19, 1970, and
recorded in the Cumberland County Recorder's Office in Plan Book 22, at Page 4.
BEING the same premises which Wonder Why, Inc., by its deed dated February 8, 1982
and recorded February 9, 1982 in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, in Deed Book "R". Vol. 29, Page 643 granted and convcyed unto
V isaggio's. Inc.

(the "project") or that may be hereafter done or furnished.
The undersigned Contractor hereby certifies and warrants that there were no
subcontractors who have provided work, services or materials on or for the above project and
that thc Release and Waiver shalI bind any subcontral.:tors or materialmen who may provide
work. or services or matcrials after the date hereof.
IN WITNESS WHEREOF, the undersigned Contractor, intending to be legally bound
