STIPULATION AGAINST LIENS
WHEREAS, OWNER entered into a contract with
S&A CUSTOM BUILT HOMES, INC. ami DAHill JANUARY 7, 2002 to
provide materials and/or perform labor necessary for the construction and
erection'or the alteration and repair of (a) bUilding(s) upon those certain
pieces or parcels of land situtated in SOUTH MIDDLETON Township,
CDMRKRTANn County, Pennsylvania, being more particularly bounded and
described as follows:

NOW, THEREFORE, it is hereby stipulated and agreed by and between the said
parties, as part of the said contract and for the consideration therein set
forth, that neither the undersigned contractor, any sub-contractor OL
materialman, nor any other person furnishing labor or materials to the said'
contractor under this contract shall file a lien, commonly called a'mechanic's
lien, for work done or materials furnished to the said building or any part
thereof.
This stipulation is made and intended to be filed with the County
Prothonotary within ten (10) days after date, in accordance with requirements
of Act of Assemble of Pennsylvania, in.such case provided.

ALL that certain tract ofland situate in South Middleton Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a survey prepared by John K. Bixler,
III, R. S., dated April 9, 19.98 and recorded in the Office of the Recorder of Deeds for
Cumberland County in Plan Book 77, Page 141 revised October 19, 1998, as follows:
BEGINNING at a point in eastem dedicated right of way line of Arlington Drive at
comer of northern intersection of West Eppley Drive; thence along dedicated right of way line of
Arlington Drive North 00 degrees 32 minutes 34 seconds East 121.95 feet to a point; thence by a
curve to the right along eastern dedicated right of way line of Arlington Drive having a radius of
175.00 feet an arc distance ofl4.41 on a chord bearing of North 02 degrees 54 minutes 04
seconds East; thence along Lot No, 50 North 86 degrees 42 minutes 52 seconds East 93,94 feet
to a point; thence by Lot No, 52 South 03 degrees 17 minutes 08 seconds East 152.00 feet to a
point; thence along northern dedicated right of way line of West Eppley Drive South 86 degrees
42 minutes 52 seconds West 88.67 feet to a point; thence along curve to the right creating the
intersection of West Eppley Drive and Arlington Drive having a radius of 15.00, an arc distance
of 24.56 feet on a chord bearing of North 46 degrees 22 minutes 17 seconds West to a point, the
Place of BEGINNING.
CONTAINING 15,083,52 square feet and designated as Lot No. 51, Section 2-B on Plan
of Forged ale Crossing.
BEING the same premises which John E. Anderson and Pauline E. Anderson, his
wife, by their deed dated November 9, 2001, and recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book
249, Page 748, granted and conveyed to Eugene I. Barrick and Judy L. Barrick,
mortgagors herein.
