COMPLAINT AND NOTICE TO DEFEND
You have been sued in court. If you wish to defend against the claims set forth in the following
pages, you must take action within twenty (20) days after this complaint and notice are served, by
entering a written appearance personally or by an altorney and filing in writing with the court your
defenses or objections to the claims set forth against you. You are warned that if you fail to do so the
case may proceed without you and a judgment may be entered against you by the court without further
notice for any money claimed in the complaint or for any other claim or relief requested by the plaintiff.

COMPLAINT
1. Plaintiff is a corporation with offices at 1001 Winstead Drive, Cary, North Carolina 27513.
2. Defendant is an adult individual residing at 39 Brian Drive, Carlisle, Pennsylvania 17013.
3. On or about December 27, 2002 Defendant entered into a Contract with Plaintiff to
provide certain services, at the specific instance and request of Defendant, Plaintiff provided these
goods and services to Defendant, as more specifically shown by the Directory Advertising Order and
Statement of Account Summary attached hereto and marked Exhibit "1" and made a part hereof.
4. Defendant received and accepled the aforementioned goods and services that were
provided by Plaintiff.
5. The prices charged by Plaintiff were fair and reasonable and were the market prices that
prevailed at the time of the transactions at issue.
6. The prices charged by Plaintiff were the prices that Defendant agreed to pay.
7. Plaintiff avers that there is a balance due and owing from Defendant in the amount of
$11,630.13, as is shown by Plaintiff's Invoice attached hereto as aforementioned Exhibit "1" and made a
part hereof.
8. Plaintiff claims interest al the rate of eighteen (18%) percent per annum from June 21,
2005 on the unpaid amount.
9. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and/or
refused to pay the aforementioned balance, legal interest or any part thereof to Plaintiff.
WHEREFORE, Plaintiff demands Judgment in its favor and against Defendant, Thomas S. Diehl,
in the amount of $11 ,630.13 with continuing interest thereon at the rate of 18% per annum from June 21,
2005 and costs.

1. PublicatioD. You, the advertiser, request that we. the publisher. R.H. Donnelley Publishing & Advertising, Inc.. publish advertisins at

2. Republint1on. We may, at our discretion. publish your advertising in successive issues of the directory(s) on tht:l same tenns;md
conditions, except that the price for the advertising will be publisher's full, starldard published price, at the then applicable rates To

do not guarantee the position of any advertising, except as $et forth in our Seniority Placement Policy, a copy of !which advertise,

ERROR OR OMISSION SUBSTANTIALLY DIMINISHES THE VALUE OF ANY UNIT OF ADVERTISING, PUBLISHER
WILL REFUND THE AMOUNT PAID fOR SUCH UNIT IN PROPORTION TO THE DIMINISHED VALUE. PUBLISHER.
ANY TELEPHONE COMPANY FOR WHICH THE DIRECTORY IS PUBLISHED. AND THEIR AGENTS AND

3. Admitted in part and Denied in part. It is specifically admitted that the Plaintiff entered into a
contract for the purpose of advertising in the Sprint Yellow Pages on or about December of 2002, The
other averments of this paragraph are specifically denied as being unknown to the Defendant. Specific
proof is demanded at trial.
4. Admitted in part and Denied in part. It is specifically admitted that the Defendant did receive
Sprint Yellow Page advertising for calendar year 2003. It is specifically denied that Defendant received
goods and services beyond that described above,
5. Denied. Prices charged by Plaintiff were neither fair nor reasonable. On the contrary, Plaintiff had
increased the price of a service that was known to it to be oflesser value than of previous years.
6. Admitted.
7. Admitted in part and Denied in part. It is specifically admitted that the Plaintiff avers that the
stated amount is due from the Defendant. It is denied however that said amounl is in fact accurate and
specific proof is demanded at trial.

eighteen percent per annum. It is denied that such an amount is due the Plaintiff from June 2\,2005 or

MOTION TO COMPEL ANSWERS TO
INTERROGATORIES AND REOUEST FOR PRODUCTION
Defendant, Thomas S. Diehl (hereinafter "Defendant"), moves this Court pursuant to
Rule 4019 of the Pennsylvania Rules of Civil Procedure for an Order compelling
plaintiff, R. H. Donnelley Publishing and Advertising, Inc. (hereinafter "Plaintiff'), to
answer Defendant's Interrogatories and Request for Production of Documents, and in
support of said motion states the following:
1. On April 19, 2006, Defendant served counsel for Plaintiff with the original and
two copies of Defendant's Interrogatories and Request for Production of Documents
Propounded upon Plaintiff (First Set).
2. On September 19, 2006, Defendant sent Plaintiffs counsel a letter notifying him
that Plaintiff s responses to discovery were still outstanding, and requesting a response
with in five (5) business days. A true and correct copy of this letter is attached hereto as
"Exhibit A".
3. As of the date of this motion, Plaintiff has failed to respond in any fashion to
either the Defendant's discovery request or the above referenced letter of September 19,
2006.
WHEREFORE, Defendant respectfully requests that this Court enter an Order
compelling Plaintiff to respond fully to Defendant's outstanding interrogatories and to
produce all requested documents within ten (10) days of the date of said Order, under
penalty of further sanctions pursuant to Pa.R.C.P 4019; OR issue a Rule to Show Cause,
if any, the Plaintiff may have for not responding to Defendant's request for discovery;
OR any other relief the Court deems appropriate.
