COMPLAINT IN EQUITY FOR PARTITION OF REAL PROPERTY
AND FOR ACCOUNTING AND PAYMENT OF RENTS DUE
1. Plaintiff, ROBERT E. HUGGLER (hereinafter referred to
as ~Plaintiff"), is an adult individual residing at 326 6tn
Street, New Cumberland, Pennsylvania.
2. Defendant, KIMBERLY ANN HUGGLER (hereinafter referred
to as ~Defendant"), is an adult individual residing at 3820
Conestoga Road, Camp Hill, Cumberland County, Pennsylvania.
3. Plaintiff and Defendant are the owners of certain real
estate situated in the Borough of New Cumberland, County of
Cumberland and State of Pennsylvania, and all the interests of
the parties in said properties are now held as tenants in common
and are undivided.
4. Plaintiff and Defendant acquired title to the premises
as husband and wife but have since been divorced.
5. The specific address of the property is 610 Bridge
Street in the Borough of New Cumberland, County of Cumberland,
and State of Pennsylvania, a copy of the present owner deed is
attached hereto, marked Exhibit ~1" and incorporated herein by
reference.
6. Plaintiff has a one-half undivided interest in the
property, as does the Defendant.
7. No person other than the parties to this suit has any
interest in the said property.
8. Defendant is in exclusive possession of the property
and Plaintiff has been excluded from possession.
9. Plaintiff believes, and therefore avers, that the fair
rental value of the property is a minimum $1,265.00 dollars per
month and that for the period of at least thirty-four (34)
months he has been denied his one-half (1/2) of the fair rental
value.
10. No partition or division of the above-described
property has ever been made and defendant has continually
refused Plaintiff's request for amicable adjustment or
partition.
WHEREFORE, Plaintiff requests:
(a) that the Court decree partition of said real estate;
(b) that the said share or shares to which the respective
parties are entitled be set out to them in severalty and that
all proper and necessary conveyances and assurances be executed
for carrying such partition into effect; and that if said real
estate cannot be divided without prejudice to or spoiling the
whole, such proper and necessary sale or sales of same may be
made by such persons and in such manners as this Honorable Court
may direct;
(c) that the Defendant account to and pay over to
Plaintiff such rents as this Honorable Court may deem
appropriate; and
(d) such other and fit relief be granted as the Court
deems just and proper.
