NO. !)(;{)(p-- 'iY7 mu) McNAUGHTON HOMES, a Division of THE McNAUGHTON COMPANY, A Pennsylvania Corporation, and THE McNAUGHTON COMPANY, a Pennsylvania Corporation, Contractor WHEREAS, JOHN 1!3. LEWIS, of 108 Sgrignoli Lane, Enola, Pennsylvania 17025 (hereinafter called "Owner"), is about to execute contemporaneously herewith, a contract with McNAUGHTON HOMES, a Division of THE McNAUGHTON COMPANY, a Pennsylvania corporation, and THE McNAUGHTON COMPANY, a Pennsylvania corporation, having a principal place of business at 4400 Deer Path Road, Suite 201, Harrisburg, Pennsylvania 17110 (hereinafter together called "Contractor"), for the erection of a dwelling house upon a lot of land situate and described as follows: ALL THAT CERTAIN piece, parcel or lot of land situate in Hampden Township, Cumberland County, Pennsylvania. and bounded and described as follows: BEGINNING at a point at the Southern right-of-way line of Heatherwood Court (50.00 feet wide), said point being located at the Northeast corner of Lot No. 147; then along said right- of-way line, North 88 degrees 30 minutes 15 seconds East, for a distance of 105.78 feet, to a point at the Northwest corner of Lot No. 149; then along the Western boundary line of Lot No. 149, South 01 degree 29 minutes 45 seconds East, for a distance of 136.23 feet, to a point in line of other lands now of formerly of The McNaughton Company; then along said other lands now or formerly of McNaughton, South 88 degrees 29 minutes 37 seconds West, for a distance of 105.78 feet. to a point at the Southeast comer of Lot No. 147; then along the Eastern boundary line of Lot No. 147, North 01 degree 29 minutes 45 seconds West, for a distance of 136.25 feet, to a point and the place of BEGINNING. This piece, parcel or lot of land consists of approximately 14,411 square feet of land, and is known and numbered as Lot No. 148 on the Final Subdivision Plan for Westbury - Phase VIIl, which is recorded in Cumberland County Plan Book 89, Page 106. BEING commonly known and numbered 5835 Heatherwood Court, Enola (Hampden Township, Cumberland County), Pennsylvania 17025. Being also identified as Cumberland County Tax Parcel No. 10-13-0993-164. /' . BEING THE SAME PREMISES which The McNaughton Company, a Pennsylvania Corporation, by its Deed dated February !l.-, 2006 and recorded on February to , 2006 in Cumberland County Deed Book , Page , granted and conveyed unto John B. Lewis, married person, Owner herein. NOW, February -1-, 2006, at the time of and immediately before the execution of the principal contract, and before any authority has been given by Owner to Contractor to commence work on the said building, or to purchase materials for the same, in consideration of the making of the said contract with Contractor and the further consideration of One and 00/100 ($1.00) Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the above described premises and the building and improvements to be erected thereon, by Contractor, or any subcontractor, or by any of the materialmen or workmen, or any other person for any labor provided or materials purchased, or for extra labor provided or materials purchased for the erection of said building and improvements, the right to file such liens being expressly waived.
