WHEREAS, Owner, with their principal address, 463 Church Street, Minersville, Pennsylvania, is
about to execute contemporaneously herewith, a contract, with A.P, Williams, Inc" Contractor, of
3035 North Progress Avenue, Harrisburg, Pennsylvania for the construction and/or erection of
improvements for Lot 2 of the Final Subdivision Plan for Silver Springs Market Place, dated May
20,2005, in Silver Spring Township, Cumberland County, Pennsylvania, more fully described on
Exhibit A attached hereto and made a part hereof.

NOW, this D day of F:ebrL.{ a...r~ ' 2006, at the time of the execution of the
principal contract, and before any authorIty has been given by the said Owner to the said
Contractor to commence work on the said building or to purchase materials for the same in
consideration of the making of the said contract with Contractor and the further consideration of
one dollar, to Contractor paid by Owner it is agreed that no lien shall be filed against the building
by the contractor, or any subcontractor, nor by any of the material men or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased for the erection
of said building, the right to file such liens being expressly waived,
This Stipulation against Liens may be executed in counterparts, each of which shall be fully
effective as an original and all of which together shall constitute one and the same instrument,

All that certain tract of land, being known as lot no, 2, being shown on a final subdivision plan
titled Silver Spring Market Place, prepared by Raudenbush Engineering, Inc" job no, 04100,
sheet SD-2, dated May 20,2005, last revised Ju]y 12,2005, being more fully bounded and
described as follows to wit:
BEGINNING at a concrete monwnent on the southerly right-of-way line (variable width) of
Car]isIe Pike (S,R. 0011) and a 30 foot wide right-of-way adjoining lands now or formerly of
Sutliff Enterprises, Inc, (deed book K-36, page 1147); THENCE along the aforementioned
southerly right-of-way of Carlisle Pike the following three (3) courses:
I. South 880 37' 57" East, 50,00 feet to an iron pin;
2, North 01022' 03" East, 10,00 feet to a concrete monwnent;
3, South 880 37' 57" East, 236.03 feet to an iron pin at lands now or formerly oflot no, 1 of the
aforementioned subdivision plan; THENCE in and through a 26 foot wide shared access
easement and along said lands oflot no, I of the aforementioned subdivision plan, South 01029'
29" West, 523,96 feet to an iron pin along a 50 foot wide right-of-way adjoining lands now or
formerly ofUD Properties, LP (deed book 262, page 4523; plan book 68, page 62); THENCE
along said 50 foot wide right-of-way, North 89005' 09" West, 313,60 feet to an iron pin along
the aforementioned 30 foot wide right-of-way adjoining lands of the same and lands of the
aforementioned Sutliff Enterprises, 1nc,; THENCE along said 30 foot wide right-of-way, North
04032' 48" East, 517,24 feet to a concrete monument along the aforementioned right-of-way line
of Carlisle Pike, said concrete monwnent being the PLACE OF BEGINNING,
