Tammy jumper, at all relevant times hereto, was an adult-individual, who resided at 130 Bell Street, Birmingham, Alabama 35217. 2. Deborah S. Cless, at all relevant times hereto, is an adult individual, who resided at 233 South Hanover Street, Carlisle, Pennsylvania 17013. 3. On October 19, 1996, Leroy Donald jumper and Tammy Beatrice Moseley were legally married in Rankin County, Mississippi, by judge William McLondon. (Certificate of Marriage is attached hereto as Exhibit "A"). 4. Thereafter, Leroy and Tammy jumper moved to North Carolina. 5. On September 22, 1997, Leroy jumper and Tammy jumper had a child together, Tabitha Elizabeth jumper, in Forsyth County, North Carolina. (Birth Certificate of Tabitha jumper is attached hereto as Exhibit "B"). 6. Thereafter, Leroy jumper moved to Pennsylvania, and Tammy jumper moved with Tabitha jumper to Alabama. 7. Leroy jumper never filed for divorce from Tammy jumper. 8. Leroy jumper never filed for an annulment of his marriage to Tammy jumper. 9. Leroy jumper never received a decree of presumed death of Tammy jumper. 1 O. Tammy jumper never filed for divorce from Leroy jumper. 11. Tammy jumper never filed for an annulment of her marriage to Leroy jumper. 12. On or about October 20, 2005, Leroy jumper and Deborah Cless applied for a marriage license in Cumberland County, Pennsylvania. 13. Upon applying for the marriage license noted in paragraph twelve of this action, Leroy jumper knowingly misrepresented to the court that he had no prior marriages. (Marriage Application attached hereto as Exhibit "C"). 14. Tammy jumper did not consent to Leroy jumper's attempt to enter into a marriage with Deborah Cless, nor was Tammy jumper aware of such. 15. 23 Pa.C.S.A. ~3304 expressly voids an alleged marriage "where either party at the time of such marriage had an existing spouse and the former marriage had not been annulled nor had there been a divorce except where the party had obtained a decree of presumed death of the former spouse." 16. Pursuant to 23 Pa.C.S.A. S 3304, the marriage between Leroy Jumper and Deborah Cless is void and therefore annulled. WHEREFORE, Plaintiff, Tammy Jumper, respectfully requests this Honorable Court enter an order pursuant to 23 Pa.C.S.A. S3306 declaring Leroy Jumper's alleged marriage to Deborah Cless void.
