DEFENDANTS' JOINT MOTION TO COMPEL PLAINTIFF FOR INSPECTION OF PROPERTY Defendants, by and through their attorneys, hereby file the following Motion to Compel, and in support thereof, aver as follows: I. Plaintiffs initiated the instant action for property damage, loss of trees, which they allegedly suffered when Defendants entered onto their property and destroyed some trees, which developing land abutting Plaintiffs property. A copy of Plaintiffs Complaint is attached hereto as Exhibit "A." 2. In an effort to discern the location of the alleged trees, the types of trees, the topography of the area and other infonnation, the parties scheduled an inspection of Plaintiffs property, which was to occur on September 29, 2005. 3. By letter dated August 15, 2005, counsel for Follmer Excavating, Inc. infonned Plaintiffs counsel that he would like to schedule a site inspection and indicated that he would like Plaintiffs and their counsel to be present at the inspection. A copy of the August 15, 2005 letter is attached hereto as Exhibit "Bo" 4. As noted above, the inspection was scheduled for September 29, 2005. A copy of the August 24, 2005 letter confinning the inspection for September 29,2005 is attached hereto as Exhibit "c." 5. Counsel for all Defendants, as well as some of their respective experts, were present at the inspection, however both Plaintiffs and their counsel failed to appear at the inspection. Additionally, Plaintiffs' failed to infonn Defendants that neither he nor his clients intended to appear at the inspection. A copy of the undersigned's September 29, 2005 letter regarding the site inspection is attached hereto as Exhibit "Do" 6. Since that date, Defendants have attempt to schedule a second inspection of Plaintiffs property, however, Plaintiffs counsel has failed to respond to requests. Attached are copies of counsels' October 10, 2005 and December 27, 2005 requesting a second site inspection as Exhibit "Eo" See also Exhibit D. 7. This discovery is essential to Defendants' preparation of their defense. 8. Plaintiffs' failure to respond is unreasonable, dilatory and prejudicial. 9.
