who is/are the mortgagor(s) and real owner(s) of the property hereinafter described.
On 08/27/1998 mortgagor(s) made, executed and delivered a mortgage upon the premises
hereinafter described to NORTH AMERICAN MORTGAGE COMPANY which mortgage is
recorded in the Office of the Recorder of CUMBERLAND County, in Mortgage Book No. 1478,
Page: 902. By Assignment of Mortgage recorded 1/11/2000 the mortgage was Assigned To
PLAINTIFF which Assignment is recorded in Assignment Of Mortgage Book No. 635, Page 577.
4. The premises subject to said mortgage is described as attached.
5. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 11/01/2005 and each month thereafter are due and unpaid, and by the terms of said
mortgage, upon failure of mortgagor to make such payments after a date specified by written
notice sent to Mortgagor, the entire principal balance and all interest due thereon are collectible
forthwith.

The attorney's fees set forth above are in conformity with the mortgage documents and
Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriffs Sale. If
the Mortgage is reinstated prior to the Sale, reasonable attorney's fees will be charged.
8. Notice of Intention to Foreclose as set forth in Act 6 of 1974, Notice of Homeowner's Emergency
Assistance Program pursuant to Act 91 of 1983, as amended in 1998, and/or Notice of Default as
required by the mortgage document, as applicable, have been sent to the Defendant(s) on the
date(s) set forth thereon, and the temporary stay as provided by said notice has terminated because
Defendant(s) has/have failed to meet with the Plaintiff or an authorized consumer credit
counseling agency, or has/have been denied assistance by the Pennsylvania Housing Finance
Agency.
This action does not come under Act 6 of 1974 because the original mortgage amount exceeds
$50,000.
WHEREFORE, PLAINTIFF demands an in rem Judgment against the Defendant(s) in the sum of $
117,249.22, together with interest from 02117/2006 at the rate of $21.95 per diem to the date of
Judgment, and other costs and charges collectible under the mortgage and for the foreclosure and sale of
the mortgaged property.

ALL THAT CERTAIN property situated in the Borough of New Cumberland, Cumberland County, Pennsylvania, more
particularly bounded and described as follows, to wit:
BEGINNING at a point on the northerly line of Simpson Ferry Road at the dividing tine between Lots Nos. 48 and 49 on
the hereinafter mentioned Plan of Lots; thence in a northwesterly direction along the said dividing line, 105 feet to Lot
No. 35 on said plan; thence in a southwesterly direction along said Lot No. 35, a distance of 52.03 feet to Lot No. 50 on
said plan; thence in a southeasterly direction along said No. 50, a distance of 96.46 feet (erroneously described as 93.19
feet on the said Plan), to the northerly line of Simpson Ferry Road; thence in a northeasterly direction along the curve of
Simpson Ferry Road by a curve to the left having a radius of 262.26 feet, a distance of 90 feet to Lot No. 48 on said Plan,
the Place of BEGINNING.
BEING Lot No. 49 in a Plan of Lots known as Plan of Forrest Hills, said Plan being recorded in Plan Book 4, Page 54,
Cumberland County records.
HAVING thereon erected a two story dwelling house known as 1387 Simpson Ferry Road, New Cumberland,
Pennsylvania.
UNDER AND SUBJECT, nevertheless, to restrictions, conditions, and easements of prior record pertaining to said
premises.
BEING the same premises which Mark S. Ulsh and Karen M. Ulsh, his wife, by deed dated September 22, 1993 and
recorded on September 29, 1993 in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book O,
Volume 36, Page 132, granted and conveyed unto Kevin R. Rivenburg and Deborah L, Rivenburg, his wife, grantors
herein.
