Palermo, Jr., Esquire, and respectfully avers the following: 1. Appellant resides at 217 West North Street, Carlisle, Pennsylvania. 2. Appellant received Notice dated January 25, 2006, stating that as a result of his alleged violation of Section 13(A)(30) of the Controlled Substance, Drug, Device and Cosmetic Act on March 18, 2005, his driving privilege was being suspended fix a period of one year, effective March 5, 2006, at 12:0 I a.m. A copy is attached hereto as Exhibit "'A~'. 3. Suspension is improper in that (a) Appellate Counsel for Petitioner, Timothy L. Clawges of the Cumberland County Public Defender's Office filed a Notice of Appeal to the Superior Court on November 29, 2005, (attached as Exhibit "B") appealing the Order of Court entered on November 1,2005, (attached as Exhibit "C") said appeal being within the 30 days allowable by law to appeal a criminal conviction; and (b) The Pennsylvania Department of Transportation lacked independent authority to administratively suspend or revoke the license in question, pending an appeal. 4. It is believed that the Pennsylvania Department of Transportation is without subject matter jurisdiction to enter or seek a license suspension where the charge has been appealed. 5. A Supersedeas is appropriate in this matter if and until these issues can be resolved, especially given the high likelihood of success by Appellant/Petitioner. WHEREFORE, your Appellant respectfully requests this Honorable Court to schedule an evidentiary hearing on the matter and in the meantime to grant a Supersedeas pursuant to the Vehicle Code, for the just reasons stated above.
