Home My WebLink About02-27-06 FAMILY SETTLEMENT AND FINAL RELEASE IN THE ESTATE OF MARIA BENDER ESTATE NUMBER 21-05-0623 KNOW ALL MEN BY THESE PRESENTS, that: WHEREAS, Maria Bender, late of Cumberland County, Pennsylvania, died testate on June 22, 2005, having first made her last Will and Testament which was duly executed on August 2, 1999; and, WHEREAS, the said last Will and Testament named Marlin E. Bender, Jr., Executor of her last Will and Testament; and, WHEREAS, Letters Testamentary were duly issued by the Register of Wills of Cumberland County, Pennsylvania to Marlin E. Bender, Jr. on July 12, 2005; and, WHEREAS, the Executor has gathered the assets of the estate of the said decedent and the assets consisted of real estate, an annuity and personal property, to a total value of $119,557.63, as set forth in the Statement of Account of Executor which has been attached hereto as "Exhibit A"; and, WHEREAS, the debts and deductions of principal, including the payment of Pennsylvania Inheritance Tax in the said estate, have been made leaving a balance for distribution of $89,463.87 as set forth in "Exhibit A" attached hereto; and, WHEREAS, the balance for distribution has been reduced to cash and is available for distribution in accordance with the terms of the last will and testament of the said decedent. , . t i '..-.' LZ .-',. ,::m... f(V~1 ,"-,,/ II NOW, THEREFORE, KNOW VE, that I, being the sole beneficiary of Maria Bender, do hereby acknowledge that I have this day agreed to receive from the aforesaid personal representative, in full satisfaction and payment of all sum or sums of money, legacies, bequests, and devises as are given, devised and bequeathed to me by my mother, Maria Bender, due to me under her said Last Will and Testament, the sum of $14,393.87, which amount have received previously from the estate. I have received by deed dated December 29,2005 the real estate situate at 10 Meadowbrook Road, Carlisle, Pennsylvania. AND, I do hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, I agree that no account is necessary and I do hereby agree that I do consent to distribution being made without the filing of an account and schedule of distribution, the same to be with the same force and effect as if they had been filed and confirmed by the Orphans' Court Division of the Court of Common Pleas of Cumberland County; THEREFORE, I do hereby covenant and agree that should any liability come due to the estate of the said decedent after the signing of this agreement, I covenant and agree that I will pay any legally enforceable claims, demands, suits, or causes of action which may be successfully prosecuted against the said estate or the aforesaid personal representative after the signing, sealing and delivery of this family settlement agreement and final release.
