WHEREAS, Fred A. Tiday, an adult individual, of Enola, Cumberland County, Pennsylvania,
"Owner," is about to contemporaneously herewith execute a contract with Fred A, Tiday Builders, Inc" a
Pennsylvania Corporation by its duly authorized officers, with a principal mailing address of PO Box
777, New Kingston, Cumberland County, Pennsylvania 17072, "Contractor," for the erection/renovations
upon a certain lot of land situate and known as Lot #8 on the Final Subdivision Plan of Appalachian
Estates, Middlesex Township, Cumberland County, Pennsylvania which is more particularly described
on Exhibit "A," attached hereto and made a part hereof
NOW, this 16th day of February, 2006, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owner to the said Contractor, to
commence work on the said building, or purchase materials for the same in consideration of the making
of the said contract with the Contractor and the further consideration of One ($1.00) Dollar and other
valuable considerations, receipt of which is hereby acknowledged, to the Contractor paid by the Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any sub-Contractor nor by
any of the material men or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection/renovations to said building, the right to file such liens
being expressly waived,
WITNESS our hands and seals the day and year aforesaid.

ALL THAT CERTAIN lot or parcel of ground situate in Middlesex Township, Cumberland County,
Pennsylvania, being Lot #8 of the Final Subdivision Plan for Appalachian Estates, and more particularly
bounded and described as follows:
BEGINNING at a point on the western right-of-way line of Appian Drive; said point being a common
property comer of Lot #7 and Lot #8 of the aforesaid Plan; thence from said point of beginning along
said western right-of-way line of Appian Drive, the following two (2) courses and distances: (1) South
17 degrees 43 minutes 26 seconds East, a distance of 177 .95 feet to a point; thence (2) by a curve to the
right having a radius of 475.00 feet and an arc length of 56.95 feet (with a chord bearing of South 14
degrees 17 minutes 22 seconds East and a chord distance of 56.91 feet to a point at a common property
comer of Lot #8 and Lot #9 on the aforesaid Plan; thence along said Lot #9, South 79 degrees 07 minutes
5 I seconds West, a distance of 462.19 feet to a point at a common property comer of Lot #8, Lot #9 and
lands now or late of Ryder G. Weir; thence along a portion of said lands now or late of Ryder G, Weir
and a portion of lands now or late of George C. Wolfe, If., North 04 degrees 35 minutes 05 seconds
West, a distance of 184.42 feet to a point at a common property comer of Lot #8, Lot # 7 and lands now
or late of George C. Wolfe, Jr.; thence along said Lot #7, North 72 degrees 16 minutes 34 seconds East, a
distance of 420.37 feet to a point, said point being the place of BEGINNING,
CONTAINING 92,041.31 square feet, more or less, or 2.1130 acres, more or less.
BEING PART OF THE SAME PREMISES WHICH Braam Hattingh, an unmarried man, by his Deed
dated February 16, 2006 and recorded February 16, 2006, in the Office of the Recorder of Deeds of
Cumberland County, Pennsylvania in Deed Book at Page transferred
and conveyed unto Fred A. Tiday, an adult man, Owner herein.
