2933 North Front Street, Harrisburg, P A (Supreme Court Attorney LD. No.
72952) as counsel for Petitioner, the cost of which is to be paid by the county
of Petitioner's residence, subject to reimbursement by the Commonwealth
and to doculuentation by counsel that Petitioner is unable to pay such costs.

PETITION FOR REVIEW HEARING AND
FOR ORDER FOR PAYMENT OF COUNSEL AND EVALUATION FEES
AND NOW COMES, Victoria 1. Marzullo, previously adjudicated an
incapacitated person (hereinafter, Petitioner), through her relator, Larry Cottle,
Adn1inistrator, Shippensburg Health Care Center, pursuant to 20 Pa. C.S.A. 9 5512.2(a),
to request a prompt review hearing to determine, as permitted by 20 Pa. C.S.A. 95517,
that Petitioner is no longer incapacitated, and, in support hereof states:
1. The Honorable Court of Franklin County, Pennsylvania entered an Order
of incapacity with respect to Petitioner on July 7, 1995, a copy of which is
attached here and incorporated by reference.
2. Petitioner is currently a resident of Shippensburg Health Care Center, 121
Walnut Bottom Road, Shippensburg, Cumberland County, Pennsylvania.
3. Larry Cottle, NHA, is the Administrator of Shippensburg Health Care
Center, a licensed nursing facility participating as a provider in the
Pennsylvania Medical Assistance Program.
4. Pursuant to 42 D.S.C. 9 1396r(c)(1)(A) and 55 Pa. Code 9 1187.21(3), a
nursing facility participating in the Pennsylvania Medical Assistance
Program must protect and promote the rights of each resident.
5. The Guardian appointed for Petitioner has died, no new Guardian has been
appointed, and there currently exists a vacancy in the office of Guardian
for Petitioner.
6. There has been a significant change in Petitioner's condition and capacity,
which is described in the attached statement by Petitioner's attending
physician (Exhibit A).
7. Petitioner is currently receiving Medical Assistance benefits for nursing
facility care at Shippensburg Health Care Center and is required by law to
contribute from any income or resources for the costs of such care and is
otherwise without funds to pay for counsel in this matter.
8. The prompt determination of Petitioner's capacity is necessary not only to
vindicate Petitioner's rights to independent and self-determination
pursuant to 20 Pa. C.S.A., Chapter 55, but also for the proper exercise of
Petitioner's rights as a resident of Shippensburg Health Care Center to
participate in care planning and care decisions pursuant to 42 D.S.C. 9
1396r(c) (relating to residents' rights requirements) and to remove any
uncertainty concerning authorization and consent for care for those
providing care to Petitioner, including uncertainty created by the current
vacancy in the office of Guardian.

Dear Mrs. Antoun:
As per the capability form completed at the time of Ms. Vickie Marzullo's
Shippensburg Health Care Center admission in 1997 ("Patient's Ability to
Understand Rights and Responsibilities"), I continue to feel she is capable
of rnaking decisions about her care.
A fvlini-Menta! Status A.ssessment, completed during 1999, continues to
support this: reflecting fair orientation, good recall, and the ability to
comprehend and follow directions.
Ms. Marzullo's primary diagnosis remains Closed Head Injury due to MV A.
with Intracranial and Subarachnoid Hemorrhage (April 1995). She is
aphasic but does use a communication device (spelling board) to express
her thoughts, wishes, and questions in a very focused manner.
PrognosIs for any further improvement in physical function is, of course,
poor.

AND NOW comes Victoria Marzullo, Petitioner, by Capozzi and Associates, P .C. and
Elizabeth S. Antoun, R.N., Esquire, and presents this Motion for Continuance of the Review
Hearing, there appearing good cause for same due to allegations that the incapacitated person is
