WHEREAS, KOLLAS AND COSTOPOULOS. of I 104 Femwood Avenue,
Camp Hill, Cumberland County, Pennsylvania, hereinafter referred to as Owner, is about to
execute contemporaneously herewith. a contract, with Glenn Snider, Jr., and Glen Miller,
t/d/b/a SNIDER-MILLER BUILDERS, for the erection of a house ancillary to development in
a complex known as Wertz Run Heights, Phase II, Cumberland County, Pennsylvania,
construction described as follows:
ALL THOSE CERTAIN tracts or parcels of ground on Lot No. I of North
Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and
described as set forth in Exhibit "A" attached hereto and made a part hereof.
NOW, this 14th day of February, 2006, at the time of and immediately before the
execution of the principal contract dated February 14, 2006, and before any authority has been
given by the said Owner, to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the marking of the said contract with Owner,
and the further consideration of One Dollar and 00/1 00 ($1.00), to Contractor paid by Owner, it
is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor,
nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.

BEGINNING at a point, said point being located on the southern right-of-way line of
Ridge Avenue at the common front property comer of Lot #2 and Lot #1 of Wertz Run Heights,
Phase 2; thence along the southern right-of-way line of Ridge Avenue the following 3 courses:
1) South 52 degrees 45 minutes 00 seconds East, a distance of 39.57 feet to a point;
2) On the arc of a curve, curving to the left having a radius of 375.00 feet, an arc
length of 312.27 feet, and a central angle of 47 degrees 43 minutes 34 seconds to a point;
3) North 79 degrees 31 minutes 27 seconds East, a distance of 38.43 feet to a point at
land now or late of Kollas and Costopoulos, Kingsbrook, Section VII; thence along land now or
late of Kollas and Costopoulos, Kingsbrook, Section VII South 20 degrees 32 minutes 03
seconds West, a distance of245.00 feet to a point at Lot #13 of Wertz Run Heights, Phase 2;
thence along Lot #13 North 73 degrees 45 minutes 31 seconds West, a distance of255.33 feet to
a point at Lot #12 of Wertz Run Heights, Phase 2; thence along Lot #12 North 52 degrees 45
minutes 00 seconds West, a distance of 175.00 feet to a point at Lot #3 of Wertz Run Heights,
Phase 2; thence along a portion of Lot #3 and Lot #2 North 37 degrees 15 minutes 00 seconds
East, a distance of 175.00 feet to a point; the point of BEGINNING.
Said lot contains 77,843.16 square feet or 1. 787 acres.
Said lot is subject to an 80' wide storm pipe excavation easement as located and shown on
the Final Subdivision Plan of Wertz Run Heights, Phase 2.
