U.S. Bank Home Mortgage (hereinafter "Plaintiff') by its attorneys, Phelan Hallinan and
Schmieg, LLP, respectfully requests this Honorable Court to enter an Order to equitably assign
the mortgage from Inland Mortgage Corporation to U.S. Bank Home Mortgage, and in support
thereof, avers the following:
1. Plaintiff is U.S. Bank Home Mortgage, a corporation with an address of 480I
Frederica Street, Owensboro, KY 42301.
2. Defendant Inland Mortgage Corporation is a mortgage company with a last known
address of9265 Counselor's Row, Indianapolis, IN 46240.
3. On March 31, 1995, Russell T. Olson and Debra A. Olson made, executed and
delivered a Mortgage upon the premises at 400 Mountain Street, Lot B, Summerdale, PA 17093
(the "Property") to Inland Mortgage Corporation, in the principal sum of $79,850.00, which was
duly recorded in the Office of the Recorder of Deeds of Cumberland County on April 19, 1995 in
Book 1259, Page 247 (the "Mortgage"). A true and correct copy of the Mortgage is attached
hereto, made part hereof, and marked as Exhibit "A."
4. The Mortgage was then sold to Plaintiff, but no Assignment of Mortgage was
recorded in the Office of the Recorder of Deeds of Cumberland County.
5. Russell T. Olson and Debra A. Olson paid their loan in full, and Plaintiff seeks to
mark the Mortgage satisfied of record, but does not have the legal ability to do so since it is not
the Mortgagee ofrecord.
6. Plaintiff has made numerous unsuccessful attempts to contact Inland Mortgage
Corporation in order to have an Assignment filed of record.
7. Inland Mortgage Corporation no longer exists, and Plaintiff has been unsuccessful
in attempts to locate the company or any of their officers.
8. Principles of equity dictate that the mortgage be equitably assigned to Plaintiff, so
that Plaintiff can mark the Mortgage satisfied of record.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court enter an Order to
equitably assign the Mortgage from Inland Mortgage Corporation to U.S. Bank Home Mortgage,
and that Plaintiff holds a valid Mortgage lien on the property located at 400 Mountain Street, Lot
B, Summerdale, P A 17093.
