AND NOW, comes David F. Heckendorn, by and through his court-appointed
attorney, Leslie A. Tomeo, Esquire, and in support of this Petition avers as follows:
1. By Order dated February 28, 2005, the Court has directed undersigned counsel to
provide the name of a reputable licensed health professional to conduct an independent
evaluation of Mr. Heckendorn.
2. The undersigned counsel has located John Hume, M.D., who is an expert in
the field ofpsychiatryo
30 Dr. Hume has agreed to evaluate the Defendant at his rate of$150 per hour.
40 Dr. Hume estimates that he will need approximately six (6) hours of
evaluation and review time to properly diagnosis Mr. Heckendorn.
50 Defendant needs Dr. Hume's evaluation to accurately present his current mental
condition.

WHEREFORE, the Defendant respectfully requests that the Court appoint Dr.
John Hume, at his rate of $150 per hour, to review necessary records and evaluate
Defendant regarding his mental state.

Heckendorn, in this action; that she makes this Affidavit as attorney because she has
sufficient knowledge or information and belief, based upon her investigation of the
matters averred or denied in the foregoing document; and that this statement is made
subject to the penalties of 18 Pa. C.S. 94904, relating to unsworn falsification to
authorities.
