REQUEST FOR ENTRY OF FINAL ORDER PURSUANT TO RULE TO SHOW CAUSE
WHEREAS, Petitioner requests a Final Order of Court be approved pursuant to a
Rule to Show Cause and sets forth the following in support thereof:
1. Petitioner, pursuant to a Petition for Wrongful Death Settlement filed on February 2,2006,
requested that this Honorable Court approve the Wrongful Death Settlement and proposed
distribution in the above-captioned matter.
2. Pursuant to same petition, the Honorable Court issued a Rule to Show Cause to Respondent,
Freddie Johnson, Jr., which required an answer within 20 days of service to respondent, as
set forth in Pennsylvania Rules of Civil Procedure.
3. There has been no answer filed nor any request for additional time to file an answer as of
March 6, 2006, which is approximately 25 days after service of the Rule to Show Cause to
Respondent.
4. Pennsylvania Rules of Civil Procedure, Title 42, S 206.7(a), sets forth as follows:
"If an answer is not filed, all averments of fact in the petition may be
deemed admitted for the purposes of this subdivision and the Court shall
enter an appropriate order."
5. Petitioner requests that this Honorable Court approve the proposed order set forth herein as
the Final Order in this matter approving the Wrongful Death Settlement and distribution of
estate assets, including insurance proceeds.
6. As pursuant to Section S 206.7(a), respondent has not filed an answer which disputes the
averments in the original Petition for Wrongful Death Settlement, and therefore the attached
order is appropriate.
THEREFORE, Petitioner requests that the Court approve the attached Order for
approval of the Wrongful Death Settlement and distribution as set forth therein.
