WHEREAS, Higgins Development Partners, LLC, of 101 East Erie, Suite 800, Chicago, Illinois
60611, is about to enter into a contract with R. S. Mowery & Sons, Inc., of 1000 Bent Creek
Boulevard, Mechanicsburg, Pennsylvania, 17050 for construction of the Key Distribution Center to
be located at 1700 Ritner Highway, Borough of Carlisle, Cumberland County, Pennsylvania.
NOW, Monday, February 27, 2006, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Higgins Development
Partners, LLC, to the said R. S. Mowery & Sons, Inc., to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with R. S.
Mowery & Sons, Inc., and the further consideration of One Dollar to R. S. Mowery & Sons, Inc., paid
by Higgins Development Partners, LLC, it is agreed that no lien shall be filed against the building or
property by the contractor, nor any subcontractor, nor by any of the material men or workmen nor
any other person for any labor, or materials purchased, or extra labor or materials purchased for the
completion of said building, the right to file such liens being expressly waived.
