Corporation. hereinafter referred to as Contractor,

Russell D. Tiday and Nichele R. Tiday. husband and wife.
hereinafter referred to as Owners, wherebY the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Hampden Township. Cumberland
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" whiCh is attached hereto and made a part hereof and
known as Lot #43 Good Hope l"aJ:11lll South. Hampden TOWElllhip.
Cumberland County, Pennsylvania.
NOW TRBUFORl. THIS 1I.GREEMBNT WITNESSETH: That the said
Contractor, for an in conside~ation of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said CORtractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file. and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL that certain piece, parcel and tract of land situate in Centre Township, Perry County,
Pennsylvania, more paJ1icularly bounded and described as follows, to wit:
BEGINNING at a point in the center of Township Road T -375, which point is located south
5 degrees 58 minutes 30 seconds East 30 feet from a concrete monument located on the
northern side of the dedicated right of way for said Township Road and which poiut is also
the common corner with land now or formerly of George Rodets; thence perpendicularly
across said road, through said concrete monument and along lands now or formerly of
Rodets, north 5 degrees 58 minutes 30 seconds West 572.30 feet to an iron pin at lands now
or formerly of Thebes; thence north 70 degrees 38 minutes 34 seconds East 189.68 feet to an
iron pin at the northwestern corner of Lot No.2 in the hereinafter described Plan of Lots;
thence by the western side of Lot No.2 aforesaid, south 5 degrees 52 minutes 35 seconds
East 619.46 feet to a point within the cartway for Township Road T-375; thence along a line
withiu the cartway for Township Road T -375 south 85 degrees 02 minutes 23 seconds West
183.45 feet to a point, the place of BEGINNING.
BEING Lot No.1 in a Plan of Lots surveyed for the Margaret E. Hutzel Estate by Dallas G.
Clouser, Registered Surveyor, on September 29, 1977, as recorded in Perry County Plan
Book 11, Page 62.
