STIPULATION AGAINST LIENS
THIS AGREEMENT made this 27th
between Neidlinger Construction, a
referred to as Contractor,
day of February,
sole proprietor,
2006, by and
hereinafter
AND
Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in West Pennsboro Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot #2
Stonecrest Acres, Newville, PA 17241.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic'S liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic'S liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Neidlinger Construction, known to me (or satisfactorily proven)
to be the person whose name is subscribed to the within
instrument, and acknowledged that he executed the same for the
purposes therein contained.

ALL that certain lot of land situate in West Pennsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a parker kalon nail set on the centerline of T-434 also known as
Green Hill Road at the dividing line of Lot NO.2 herein conveyed and Lot No, 3 as
shown on the hereinafter mentioned Subdivision Plan; thence from the centerline
North 01 degree 42 minutes 25 seconds West a distance of 63,50 feet to an iron
pin on the Eastern existing right of way line of said T-434, also known as Green Hill
Road; thence from the eastern existing right of way line North 58 degrees 04
minutes 49 seconds West a distance of 7.31 feet to an existing iron pin; thence
North 58 degrees 04 minutes 49 seconds West a distance of 58,84 feet to a parker
kalon nail on the centerline of said T-434, also known as Green Hill Road at the
dividing line of Lot 1; thence along Lot 1 North 32 degrees 03 minutes 30 seconds
East passing through an iron pin 24.21 feet from beginning point a distance of
84.21 feet to an iron pin; thence continuing along Lot 1 North 51 degrees 31
minutes 35 seconds East a distance of 335.96 feet to an iron pin at the dividing
line of Lot 20; thence aiong Lot 20 South 49 degrees 05 minutes 41 seconds East a
distance of 274.69 feet to an iron pin; thence continuing along Lot 20 South 01
degree 42 minutes 25 seconds East a distance of 185,25 feet to an iron pin at the
dividing line of Lot No.3; thence along Lot NO.3 South 88 degrees 17 minutes 35
seconds West a distance of 463.00 feet passing through an iron pin 24.93 feet
from end point to a parker kalon nail on the centerline of T-434 aiso known as
Green Hill Road, the Place of BEGINNING.
Being Lot NO.2 on a Land Subdivision for Stonecrest Acres recorded in
Cumberland County Plan Book 81, Page 124.
