Defendant(s) CIVIL DIVISION - LAW COMPLAINT The Plaintiff, NATIONAL WATERWORDS, by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of THREE THOUSAND SIX HUNDRED THIRTY SIX DOLLARS AND EIGHTEEN CENTS ($3,636.18) plus interest at the statutory rate from August 27, 2005, upon a cause of action of which the following is a statement: 1. The Plaintiff, NATIONAL WATERWORKS, INC., is a corporation organized and existing under the laws of the State of Ohio, having its principal office and place of business in Waco, Texas. 2. The Defendant, STEPHEN E. WESTHAFER, Personal GuarantorforWesthaferConstructio, Inc., is an adult individual, residing at 120 West Allen Street. Mechanicsburg, Cumberland County, Pennsylvania 17055. 3. The Defendant, WESTHAFER CONSTRUCTION, INC., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania having an office and place of business at 120 West Allen Street, Mechanicsburg, Cumberland County, Pennsylvania 17055. On or about October 22,2004, Defendants completed a Credit Application, complete with Personal Guaranty, for the future purchase of certain business equipment by Defendants from Plaintiff. A true and correct copy of said Credit Application/Personal Guaranty is attached hereto, marked Exhibit "A" and made a part hereof. 5. On the dates, in the amounts, and for the prices set forth in a truEl and correct copies of Plaintiff's Invoices attached hereto, collectively marked Exhibit "B" and made a part hereof, Plaintiff, at the special instance and oral request of the Defendants, sold and delivered goods, wares and merchandise of the kind and description set forth on said Exhibit to the total amount of Two Thousand Six Hundred Thirty Dollars and Three Cents ($2,630.03). 6. The Defendants defaulted on their obligation to make payments on said invoices. 7. Due to the default of Defendants herein, interest has been added to said account in the amount of Four Hundred Dollars and Twelve Cents ($400.12) as set forth on Plaintiff's Statement of Account attached hereto, marked Exhibit "C" and made a part hereof. 8. The total balance due and owing by Defendants is the sum of Three Thousand Thirty Dollars and Fifteen Cents ($3,030.15) as set forth on Exhibit "C" attached hereto. 9. Due to the default of Defendant, and pursuant to the terms and conditions of the Credit Application and Personal Guaranty executed by Defendants, attorney's fees in the total amount of Six Hundred Six Dollar sand Three Cents ($606.03) have been added to said account. 10.
