NADAR, husband and wife, Owners PARAMOUNT DEVELOPMENT, INC., Contractor IN THE COURT OF COMMON PLEAS, CUMBERLAND COUNTY, PENNSYLVANIA No. /loaf rn D WHEREAS, Contractor has undertaken and agreed to perform the construction of a residential dwelling on that certain parcel of land situate in Hampden Township, Cumberland County, described more fully on Exhibit A. NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One ($1.00) Dollar in hand paid to it by Owners, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself and its subcontractors, and all parties acting through or under it or them, covenants and agrees that no mechamc's liens or claims shall be filed or maintained by it or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by it or any of them under said contract or otherwise, for, towards, in or about the construction of the said residential dwelling on the lot above described, and the said Contractor, for itself, its subcontractors and others under it hereby expressly waives and relinquishes the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of the improvements, and agrees that this instrument, waiving the fight of lien, shall be an independent covenant. By: "~,~_2~/~/~.~ / ALL THAT CERTAIN tract of land situate m Hampden Township, Cumberland County, Pennsylvania, being Lot No. 98 as shown on the Plan entitled Pinehurst Final Subdivision Plan Phase IVB, dated August 22, 1996, and recorded in Cumberland County Plan Book 73, Page 66, more particularly bounded and described as follows: BEGINNING at an iron pin, lying in a southerly right-of-way line of Maybelle Court (50 foot right-of- way) and being a westerly comer of LOt No. 99; thence along Lot No. 99, South 07 degrees 12 minutes 16 seconds East, 130.00 feet to an iron pin, being a westerly comer of Lot No. 99, and being a northerly comer of lands now or formerly of Pamay Development Co., Inc.; thence along said lands, South 48 degrees 59 minutes 50 seconds West, 166.70 feet to an iron pin, being a westerly comer of said lands and lying in an easterly right-of-way line of Monterey Drive (50 foot right-of-way); thence along the Monterery Drive right-of-way, along a curve to the right, having a chord bearing of North 24 degrees 06 minutes 13 seconds West, a chord distance of 159.88 feet, a radius of 275.00 feet, and an arc length of 162.22 feet to an iron pin; thence continuing along said right-of-way, North 07 degrees 12 minutes 16 seconds West, 44.75 feet to an iron pin; thence along a curve to the right, having a chord bearing of North 37 degrees 47 minutes 44 seconds East, a chord distance of 35.36 feet, a radius of 25.00 feet, and an arc length of 39.27 feet to an iron pin, lying in a southerly right-of-way line of Maybelle Court; thence along said right-of-way, North 82 degrees 47 minutes 44 seconds East, 160.00 feet to an iron pin, being the place of BEGINNING. CONTAINING 0.743 acre and being lmown apd numbered as 1932 Monterey Drive or 10 Maybelle Court. EXHIBIT A
