STIPULATION AGAINST LIENS

LINEBAUGH LAHNSTEIN GENERAL CONTRACTORS, hereinafter referred to as
Contractor,
AND
SCOTT R, EPPLEY and DEBRA V, EPPLEY, husband and wife, hereinafter
referred to as Owners,
whereby the former undertook and agreed to construct a single family dwelling, at 435
Winding Hill Road, Upper Allen Township, Cumberland County, PA, more particularly
described in attached exhibit "An
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of ;:.#tf Dollar to it in hand
paid by Owners, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument,
waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or lot of land situated in Upper Allen
Township, Cumberland County, Pennsylvania described according to
Subdivision Plan prepared by Hoover Engineering Services, Inc.,
of New Cumberland, pennsylvania, bounded and described as
follows:
BEGINNING at a point in the centerline of West Winding Hill Road
(LR 21025) at the dividing line of Lot No. 3 herein conveyed and
Lot No.2 as shown on the aforementioned Subdivision Plan; thence
along the centerline of West Winding Hill Road (LR 21025) North
66 degrees 37 minutes 00 seconds East a distance of 329.73 feet
to a point at the dividing line of Lot No.4; thence along Lot
No. 4 South 23 degrees 18 minutes 40 seconds East, a distance of
60.84 feet to a point; passing through a PK nail set 30.96 feet
from said beginning point; thence South 32 degrees 36 minutes 24
seconds West a distance of 96.16 feet to a point; thence South 16
degrees 40 minutes 18 seconds East, a distance of 206.59 feet to
an iron pin to be set at the dividing line of Lot No.2; thence
along Lot No. 2 South 54 degrees 46 minutes 00 seconds West a
distance of 588.18 feet to an iron pin to be set; thence North 55
degrees 09 minutes 30 seconds West a distance of 361.37 feet to
an iron pin to be set; thence North 61 degrees 01 minutes 45
seconds East, a distance of 542.61 feet to an iron pin to be set;
thence North 23 degrees 18 minutes 40 seconds West, a distance of
80.54 feet passing through a concrete monument 30.54 feet from
said centerline of West Winding Hill Road (LR 21025) the end
point, the place of BEGINNING.
BEING subject to a utility easement running in a North and South
direction along the eastern side of Lot.
BEING Lot 3 and Part of Lot 4A of the Preliminary/Final
Subdivision Plan for Jill C, and Timothy A. Benner and Robert W.
And Annette Coffman dated January 5, 2004, and recorded in the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in
Plan Book 89, Page 102.
BEING THE SAME PREMISES WHICH Robert W. Coffman and Annette S.
Coffman, husb~nt7ar~ ,wife, by their deed dated February 2, 2006,
and recorded I. , 2006, in the Office of the Recorder of
