STIPUAL TION AGAINST LIENS
THIS AGREEMENT made the day of , by and between

Hereinafter referred to as Contractor,
AND
Roderick I. Frazier & Gloria S. Frazier, 1009 Shannon Lane Carlisle, PA
17013 hereinafter referred to as Owner, whereby the former undertook and agreed to
erect and construct a
SINGLE F AMIL Y DWELLING on that certain lot of ground situate in
Lot #14 Hillcrest Farms, Carlisle, Cumberland County Pennsylvania, (SEE A TT ACHED
LEGAL DESCRIPTION)
NOW THEREFORE, THIS AGREEMENT WITNESSTH: That the said Contractor,
for and in consideration of the sum of ($1.00) Dollar to H&M ENTERPRISES, INC. in
hand paid by Owner, the receipt whereof is hereby acknowledged, and further
consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no
mechanics liens or claims shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on account of any work
done or materials furnished by them or any of them under said contract or otherwise, for,
towards, in, or about the erection and construction ofthe said buildings on the lot above
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument,
waiving the right oflien, shall be an independent covenant.

ALL THAT CERTAIN unimproved tract of land, situate in North Middleton Township, Cumberland County,
Pennsylvania, bounded and described in accordance with the Premliminary/Final Subdivision Plan for Phase for
Phase 2 of Hillcrest Farms West, as prepared by R.J. Fisher & Associates, Inc., dated August 9, 2005, last
revised November 11, 2005 and recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 91, Page 131, as follows:
BEGINNING at a point along the northern side of Prickly Pear Drive at the dividing line between Lots 14 and 15
ofthe aforementioned subdivision plan; thence continuing along said dividing line, North 14 degrees 34 minutes
29 seconds West, a distance of 308.38 feet to a point at the dividing line between Lots 14 and 12 of the
aforementioned subdivision plan; thence continuing along said dividing line, South 56 degrees 09 minutes 52
seconds East, a distance of 210.00 feet to a point at line of lands now or formerly of Strickland Brothers
Construction; thence continuing along line of lands now or formerly of Strickland Brothers Construction, South
01 degrees 00 minutes 18 seconds East, a distance of 185.41 feet to a point along the northern side of Prickly
Pear Drive; thence continuing along the northern side of Prickly Pear Drive, the following two courses and
distances: 1) North 87 degrees 34 minutes 30 seconds West, a distance of 8550 feet to a point; 2) thence by a
curve to the left, having a radius of275.00 feet and an arc length of 14.66 feet to a point and Place of
BEGINNING.
CONTAINING a total of 0.71 acres and being designated as Lot 14 of the aforementioned subdivision plan.
UNDER AND SUBJECT to the Declaration of Covenants, Reservations and Restrictions as recorded in Misc.
Book 724, Page 4507.
ALSO UNDER AND SUBJECT to any restrictions, easements and right-of-ways as recorded in Plan Book 91,
Page 131.
By acceptance of this Deed, the owner hereof, their successors and assigns, agree to purchase, own and
maintain the grinder pump system in accordance with Sanitary Sewer Notes as recorded in Plan Book 91, Page
131.
