WAIVER OF LIENS

WHEREAS, TURKEY HILL, L.P., 257 Centerville Road, Lancaster, PA
17603, entered into a contract with Galen G. Miller, Inc., 2882 Yellow Goose
Road, Lancaster, PA 17601, to provide materials and perform labor necessary for
completion of a convenience store situated upon a lot of ground located at:
209 West King Street, Shippensburg, PA 17257
NWC of U.S. Route 11 (W. King St.) &. N. Spring St.
Shippensburg Borough, Cumberland County, PA.

NOW, THEREFORE, it is stipulated and agreed by and between the said
parties, as part of the said contract and for the consideration therein set forth,
that neither the undersigned contractor, any sub-contractor or material man, nor
any other person furnishing labor or materials to the said contractor under this
contract shall file a lien, commonly called a mechanic's lien, for work done or
materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County
Prothonotary within ten days after date, in accordance with the requirements of
Acts of Assembly of Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties thereto have hereunto set their

of West King Street (SR 0011) and N. Spring Street (SR 4037) , in Shippensburg Borough, Cumberland
County, Commonwealth of Pennsylvania, being further bounded and described as follows:
BEGINNING at a common point on the Northern Right-of-Way line of West King Street (SR 0011) and a
corner of land now or formerly of Borough of Shippensburg;
THENCE along land now or formerly of Borough of Shippensburg North 34 degrees 11 minutes 45
seconds West, a distance of 269.21 feet to an existing RRS on the Southern Right-of-Way line of Martin
Ave;
THENCE along the Southern Right-of-Way line of Martin Ave North 55 degrees 36 minutes 33 seconds
East, a distance of 59.44 feet to a point;
THENCE along the Southern Right-of-Way line of Martin Ave and land now or formerly of William H.
Cressler North 56 degrees 46 minutes 16 seconds East, a distance of 199.47 feet to an point at the
corner of Lot 2 of said subdivision;

on the Northern Right-of-Way line of West King Street (SR 0011);
THENCE along on the Northern Right-of-Way line of West King Street (SR 0011) South 56 degrees 23
minutes 13 seconds West, a distance of 216.72 feet to a point; which is the POINT OF BEGINNING.
