HomeMy WebLinkAbout02-1212 STIPULATION AGAINST LIENS THIS AGREEMENT made this ~' day of ~/~ , 2002, by and between Chateau Custom Home Builders, Inc., of 322 Candlelight Drive, Mechanicsburg, Cumberland County, Pennsylvania, hereinafter referred to as Contractor, Brian R. Shaffer and Donine M. Shaffer, husband and wife, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Hampden Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot %10, 1400 Armitage Way, Cumberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. SEAL I(ANDI L LENKER, NOTARY PUBLIC Exhibit A ALL THAT CERTAIN parcel of land located in the Township of Hampden, County of Cumberland, Commonwealth of Pennsylvania being shown and designated as lot 10 on a plan entitled "Final Subdivision Plan - Phase I For Hampden Station", by Dawood Engineering, Inc., plan dated November 18, 1999 and last revised April 27, 2000 and recorded in Plan Book 81, Page 81. Said parcel being more fully described as follows: BEGINNING at an iron pin to be set along the southern right-of-way line of Armitage Way at the dividing line between lot 9 and lot 10 as shown on the above said plan; Thence along lot 9, South 19 degrees 05 minutes 49 seconds East a distance of 145.56 feet to an iron pin to be set at the dividing line between lot 9A and lot 10; Thence along lot 9A, South 00 degrees 26 minutes 09 seconds East a distance of 30.00 feet to an iron pin to be set at the dividing line between lot 9A and lands now or formerly of Mark & Karen E. Cosby; Thence along said lands, South 89 degrees 38 minutes 47 seconds West a distance of 164.09 feet to an iron pin to be set at the dividing line between lot 11 and lot 10; Thence along lot 11, North 07 degrees 09 minutes 15 seconds East a distance of 169.56 feet to an iron pin to be set along the southern right-of-way line of Armitage Way; Thence along said right-of-way the follOWing two (2) courses and distances: 1. South 79 degrees 57 minutes 46 seconds East a distance of 13.17 feet to an iron pin to be set; 2. Along a curve to the left, having a radius of 200.00 feet, a delta angle of 23 degrees 43 minutes 01 seconds, an arc length of 82.79 feet, and a chord bearing and distance of North 88 degrees 10 minutes 43 seconds East, 82.20 feet to at an iron pin to be set along the southern right-of-way line of Armitage Way at the dividing line between lot 10 and lot 9, the place of BEGINNING.
