Whereas, the Owner is about to execute contemporaneously herewith, a contract, with said
contractor, a corporation organized and existing under the laws of the State of Pennsylvania, for
the General Construction work located within the lot ofland situate in the Borough of
Wormleysburg, Cumberland County being known and addressed as 1027 Mumma Road, Camp
Hill, Pennsylvania, and being more fully described in Cumberland County Deed Book U,
Volume 35, Page 140 and being more particularly described on Exhibit A attached hereto,
incorporated herein by reference and made a part hereof.
Now, Therefore, on March 7
, 2006, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said owner to
the said contractor to commence work on the said project, or purchase materials for the same in
consideration of the making of the said contract with the said contractor and the further
consideration of One Dollar paid to the said contractor by the said owner, it is agreed that no
mechanic's claims or other liens shall be filed against the building and/or ground appurtenant
thereto by the contractor, or any sub-contractor, nor by any of the material men or workmen or
any other person for any labor, or materials purchased, or extra labor or materials purchased or
furnished in connection with the construction ofthe said project or any part thereof, the right to
file such liens being expressly waived and relinquished herewith.

EXHIBIT A
ALL THAT CERTAIN tract of land situate in the Borough of
Wormleysburg, County of CUmberland and Commonwealth of
Pennsylvania, known as Lot No. 4 on the Plan of Lots 4 and 5A
Pennsboro Center as recorded in Plan Book 40, Page 131, bounded
and described as follows:
BEGINNING at [an iron pin] on the southern right-of-way line of
Route #770, which point is 1104.72 feet east of the center line
of Erford Road; thence along lands now or formerly of Mowery
Associates, South forty-three degrees twenty-eight minutes
fifteen seconds East (S 430 28' 15" E), three hundred eighty-two
and forty-nine hundredths (382.49) feet to lands now or late of
Leroy W. Clark; thence along the same and lands now or late of
Martin L. Murray, South fifty-two degrees twenty-five minutes
fifty seconds West (S 520 25' 50" W) three hundred seventeen and
thirty-three hundredths (317.33) feet to a point at line of Lot
No.3 on the Plan of Pennsboro Center; thence along the same
North twenty-nine degrees zero minutes fifty-three seconds West
(N 29' 00' 53" W), one hundred eighty-two and eighty-four
hundredths (182.84) feet to a point; thence along the same North
forty-three degrees twenty-eight minutes fifteen seconds West (N
43' 28' 15" W), one hundred seventy-two and eighty hundredths
(172.80) feet to a point on the southern right-of-way line of the
said Route #770; thence along the same, North forty-si~ degrees
