STIPULATION AGAINST LIENS

THIS AGREEMENT made the 17~ day of March, 2006, by and between,
ROBE/iT J. COLDSMITH, III, of 137 Pine Tree Drive, Newvilre, Pennsylvania, hereinafter
referre' I to as Contractor,
AND
ROBE RT J. COLDSMITH, III and ERIN C. COLDSMITH, of 137 Pme Stree Drive, Newville,
Penns) :vania, hereinafter referred to as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in Cumberland, Pennsylvania, known as 786 High Mountain Road, situate
in Penn Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached
hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the lot
above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL that certain lot or tract of land situate in Penn TO"''l1ship, Cumberland County,
Pennsylvania, designated as Lot 12 as shown on Subdivision Plan entitles "Final
Subdivision Plan for Cc1a Crossings" prepared by Eric Diffenbaugh, Professional Land
Surveyor, dated June 3, 2004, revised June 23, 22004, which plan is recorded in
Cumberland County PllUl Book 89, Page J 04, and is bounded and described as follows:
BEGTh'NING at a set iron pin along the northern right of way line of David Glenn Drive
at the dividing line between Lot 12 and Lot 13 on the hereinabove referenced plan;
thence along said dividing line North 44 degrees 30 minutes 58 seconds West 185.00 feet
to a set iron pin; thence continuing along the same North 59 degrees 53 minutes 32
seconds West 340.39 feet to a set concrete monument; thence along the dividing line
between Lot 5 and Lot 12 on the hereinabove referenced plan North 55 degrees 58
minutes 21 seconds East 292.11 feet to a set ir011 pin; thence along the dividing linc
between Lot II and Lot 12 on the hereilllabove referenced plan South 41 degrees 07
minute 14 seconds east 460,84 feet to a set concrete monument; thence along tile northern
